Mr, Sani ki asked if they were continuing this without a hearing subject to receipt of revised plans in the other configuration Mr. Rosenberg stated , when a revised plan i submitted ,, the Commission will thea consider the issue of whether or not the configuration shown on the revised plan is grandfathered as being in existence as of 1972 . If the revised pian , in the opinion of the Commission , accurately re- flects what was there in 1972 , they can declare that it is grandfathered . The balance of the Notice of Intent , the staircase , can thea be discussed . If it is found that it is not grandfathered , the applicant will be so notified and the Notice of Intent rejected . Mr , Sherman asked if there was to be a new Notice of Intent and Mr. Rosenberg said no . Nancy Deli impe of Aubrey Consulting , Inc . presented abutter receipts . This filing i s in response to the Enforcement Order for cleared vegetation beyond the area allowed , power lines , catch basin and drainage pipe . It was required a plan be submitted indicating the structures on the coastal bank-, plan for removal of the catch basin and power lines and revegetation plan . Discussion between Lisa Hanscom and David Aubrey resulted in a decision that it would be unnecessary to remove the power lines , catch basin and pipe . Instead , a Notice of Intent would be filed to ask for the permitting of same and a reve etati on plan ou ld be submitted . Lisa suggested the catch basin and drain pipe u l d be more suitable than taking it out and Putting in a dry well . Jr . Rosenberg asked when the unpermitted work was done and was told it was discovered by the Conservation Commission in January or Feb- ruary . fir . Rosenberg asked if this work was done after the other Order of Conditions was issued , without permit , after the other proceedings before this Commission?
