concomm <br /> September 7, 1989 <br /> Page 5. <br /> Mrs. Simmons stated the Commission would be interested in a letter from anyone <br /> wishing to provide input, they need not be present. <br /> Mr. Deusser gave the pictures to the Commission for the file. <br /> Mr, FaLacci stated they had intended to finish up the road, work which requires <br /> regrading of the shoulders spring or summer of last year, they were told they <br /> could not. At that time Lisa Hanscom stated there would be work in the wetland <br /> area and they stopped. <br /> Mrs. Simmons stated it was never addressed. There was an enforcement order that <br /> they have never addressed and that is the problem. The Commission needs answers <br /> as to how they are going to address this drainage problem. If working in a <br /> resource area, a Notice of Intent has to be filed. <br /> Mr, Falac i stated they did not feel they were working in a resource area. They <br /> had many calls .to Lisa and felt it was not necessary to file a Notice of Intent. <br /> Ms Behrman asked if they sent a letter to that effect? <br /> Ir, Falacci stated he dropped off plans at that time, it was the sane time they <br /> appeared before the Planning Board. It was left that they were.waiting for a <br /> response from the commission on their records. <br /> Ms Behrman stated they were told to file a Notice of Intent, that' s where it <br /> was at. <br /> . Sherman stated, concerning the evidence the commission would like to see, the <br /> regulations define an intermittent stream as a stream and if there is conflict <br /> or difference of opinion, as to the extent of floodwaters., the issuing authority, <br /> which is the Commission, may require the applicant to determine the boundary of <br /> bordering land subject to flooding by engineering calculations which shall be <br /> based upon a designed storm of 7 inches precipitation in a 24 hour period. In <br /> his mind this is the information needed. <br /> Nor. Fal cci stated they are not arguing that it's an intermittent stream. <br /> Mr. Thorng agreed to show where the bordering land subject to flooding boundary <br /> is located. <br /> . Fala,cci will supply in writing the rainfall from the spring and summer. <br /> 5 <br /> Mrs, Simmons asked for the amount of fill ; distances from the stream to the house <br /> and mouse to the work limit; show the flood plain; distances to the bordering <br /> land subject to flooding, trees to be taken down flagged; l and subject to <br /> flooding flagged; revegetation plan; calculations for 7Y ear storm., <br /> Mr. Coffey asked if it would be possible to relocate the intermittent stream <br /> Mr. Sherman advised it is interrupted by an earthen dam further downstream. <br /> It runs, most of the time, underground. <br /> Ms Behrman asked if they had applied for the Board of Health permits? <br /> Mr. Fa l acc i stated they did apply a year ago but had to reperc, <br /> Mr. Sherman advised Board of Health comments state no plains have been submitted. <br /> Also, he spoke to George Gowan' concerning erosion problems down Noisy Hole Toad <br /> and Scenic Drive and asked that they be addressed months ago. A siltation screen <br /> was to have been put up. <br />
