Conservation Commission <br /> October 5, 1989 <br /> Page 7. <br /> New Seabury Corp. returned. <br /> Mrs.• Simmons stated the Commissioners would like to close on this application. <br /> Ms Dehrman moved that the Commission act on it tonight and close the hearing. <br /> Mr. Desroiers seconded the motion. <br /> Mr. Hayes asked to be allowed 10 working days to submit additional information, <br /> Ms ehr'i an advised if the hearing is Closed, additional information Cannot be <br /> accepted. <br /> Mr. Hayes asked if that wasn't what they gust did with the previous gentleman? <br /> Nis Dehrman stated if the hearing is closed row, legally, information Cannot be <br /> submitted after the closure of the hearing to be considered as part of the <br /> decision. <br /> Mr. Mayes stated he was unaware of that. <br /> Mr. Coffey stated,, earlier, at Mr, Hares request, the Commission cl osed the <br /> public hearing to allow only one more submission and that was Benoit's. <br /> Ms Dehloman stated the Commission kept it open for Mr. Benoit's submission and <br /> that was with the understanding it would be Closed after that; she read from <br /> the minutes, <br /> . Hayes asked if the Commission was going to close and make a determination <br /> tonight? <br /> Ms Behrman advised the motion has been made and seconded. <br /> Mrs. Simmons asked r. Sherman to read his opinion a-n d recommendation written <br /> for the Commission. <br /> VOTE. Motion made and seconded to close the hearing. Unanimous vote. <br /> VOTE: Motion rade and seconded for a positive finding with the Agent's essay <br /> and appending in further evidence, the letter read into the record <br /> from Jeffrey Benoit. Unanimous vote. <br /> POSITIVE DETERMINATION WITH THE APPROPRIATE FINDING ON THE TWO AREAS SUBJECT <br /> To DEFINITIONS. <br /> :oo ILFPED COOPER-for Determination oc Applicability n a proposal t Cut <br /> down and remove three rotted trees at 10 Shorewood Drive. Mr. Cooper presented <br /> abutter receipts. Photos were reviewed. <br /> Mr. Sherman stated he has seem the trees and they should Come down. The trees <br /> are about 30 feet from the water. Y <br /> VOTE: notion made and seconded to issue a Negative determination. <br /> NEGATIVE DETERMINATION. <br /> 9:15 ALBERT MULLIN JR. to expand the size of an existing kitchen at 123 Tide <br /> Run. Mullin 1 f ry presenting. It was ascertained abutters were not notified <br /> of the rearing. <br /> CONTINUED TD NOVE-MBER 1 - 7:45, A UTTE S To BE NOTIFIED, To BE READVERTISED. <br />
