Riel stated it <br /> is not keyed into anything; the form will be set up in such a way that when it' s <br /> poured it would be flush. Mr. Coffey was concerned that it stayput and asked i <br /> they were pouring concrete in the water. <br /> r. , R i e l advised the work will be done at low pond level . Thr ere was 18 feet <br /> horizontal to the edge of the pond when the work on Section B was done and Mr. <br /> 5p usta is willing to wait for similar conditions before he does any -more work. <br /> Asked when low water occurs, Mr, Spousta stated it varies. <br /> . Caffey asked if their engineer (Braman Engineering) was comfortable this would <br /> stay put. . fir. Riel stated he felt the way it was dare originally lasted 25 years <br /> and with the addition of Rebar and weepholes it would last twice that long. <br /> . Coffey asked the purpose of the PVC pipe coming out. fir. Spousta explained <br /> that was used to draw water for his shrubs. <br /> Pyr, Sherman advised D.E.P. stated that is a reason for a filing. <br /> Mr. Riel stated i f put in the Order of conditions, they will remove it during <br /> construction. <br /> Ms Beh rman read a letter into the record from Richard Mailley, President of <br /> Ashumet-John' s Pond Association. (appended) <br /> Mr. Riel started this letter implies this is new construction. The existing <br /> walls have been in place 25 years. He read from 310 CMR 10.54 sub. 4, sub.A. <br /> It was his interpretation that renovation is allowed as long as there is no <br /> enlargement. <br /> Mr. Riel advised that directly behind the sea wall is a right of way, Sakonnet <br /> Drive. Prior to 1965 when fir. Spousta constructed the sea wall , theme was suff- <br /> icient <br /> u - <br /> i ient erosion that there had to be realignment i n the direction of Mr. Spou to's <br /> house of the public night of way. Since construction, there hasn't been any need <br /> for any additional realignment. r. Spou sta is willing to keep this access open <br /> for the general public, as well as fire -control ,, etc. <br /> Mrs.. Wall asked how the existing ba.rrie s would b removed? <br /> oved <br /> Mr, S austa stated they are to be broken up with a sledge hammer and taken out on <br /> a dolly. It will be done where it sits now, in a:period of low water. fir. Ril <br /> agreed this could be written into the Order of Conditions. <br /> Mrs. Wall asked how deep the footings were and when told 6-8" she stated they <br /> would hit water. <br /> Mr. Ri l stated they have learned from experience that isn't the case. <br /> . Sherman stated, the way it is proposed to be done, he can't see where it <br /> doesn't r eet the performance standards. <br /> . Caffey asked if they would be willing to submit additional information from <br /> the engineer as the profile shows 1-1/2 feet below grade if something different <br /> is proposed. <br />
