f
Conservation commission
October 19, 1989
Page 5.
Mr. Slavinsky reed to revise the Notice of Intent to state 70 yards of fill .
Mr. Walsh, Lot 101 , stated he cannot understand why more fill would be allowed when
one condition of the building permit after the building of the seri-park was that
no more fill would be brought in,* every time i s man comes before the Board,, it is
for forgiveness afterwards.
. Slavinsky stated the idea of having a driveway in the location shown, as opposed
to the original filing, is better.
Mr. Walsh stated, if the topo hasn't charged since the original filing, why didn't
someone notice, in their infinite wisdom} that the driveway wouldn't work there?
He stated it is mind boggling that this roan does anything he wants and comes for
forgiveness after, the Beech tree is a classic example. of course,, when you out
50% of the tree down., it is time to get an Arborist to state the tree must come
down. He would like to know who owns the lot, it keeps being referred to as
Giunta, Barnstable Holding or Eppinger & Russell ; call a spade a spade.
Mrs. Walsh advised Mr. D cey' s employee, who was sawing the tree down, stated at
that moment that Nor. Regan the day before said, "Get rid of that tree, l don't
like it". Other abutters as well heard the same thing and now we have this
arborist's report that the tree was in danger of falling down. She also felt
the rip-rap should be discussed.
. Walsh stated it has gotten to the point they do not feel it is worth coming to
these meetings and asked what happened to the original house behind that?
Ms Behrman advised that is in the hands of Town counsel and he is taking action.
Mrs. Walsh questioned the legitimacy of this hearing where the owner of the property
is not being dealt with. She wondered if at some time in the future when a plan has
been proposed or something came before the Board's attention if it could thea be said
it was not the owner of record; the owner of record is Nor. Regan. She did not feel
the entire hearing tonight is legal ; there is nothing here which states who the
property owner is.
Ms Behrman asked Mr. Slavinsky if, as far as he is concerned, the owner of record i
Eppinc er & Bussell?
Mr. Slavinsky stated that is the only thing the Assessor's office would sign.
Mr. Walsh asked Mr. Slavinsky who he did this work for and was told he was hired b
Barnstable Holding Company, the builder.
Ms Behrman stated this is being brought in the name of Joseph Giunta who was the
original applicant for the house. An order of conditions has to be issued i n the
name of the owner of record for recording.
Mr. Slavinsky stated it is registered against the lot. It may have changed hands
but the Assessor' s will only sign according to thein records. He was under the
impression Regan had it under agreement.
Mrs. Walsh advised Mr. Regan is renting out the house and does not have an occupancy
permit. He has two families living in it.
Ms Behrman stated there does seem to be a question of whose name should be on the
plan. Sh e asked that this be clarified.
