Mr. Hayes stated the plants are already in; they were ones that were there <br /> when the stairway was pint i n. The plan was developed for a DEQE number and this one <br /> for DEP with one part done and one requested. <br /> Nor. Somerville was asked if he could provide an evaluation prior to Ir. Hayes <br /> return and he stated he would. <br /> Mr. Coffey suggested if an EI 's involved, there was no point in his returning <br /> in a hurry. <br /> Ms Behr rman stated it could be denied without prejudice, <br /> CONTINUED To JANUARY 11 , 1990 <br /> 8:00 George Regan, continued from October 9, Dave Sanicki presenting. This was <br /> originally a request for an Amended order for an added deck. Unknown to his firm, <br /> additional fill had been brought onto the site and the Commission requested an <br /> amended Notice of Intent which is now on file. The deck dimension is now shown <br /> on the plan and rip-rap has been changed to a D-shape back to Tamberlane Drive. <br /> The deck is shown as presently constructed. A landscape plan was requested as <br /> someone had cut down an excess of trees, a replanting plan was put before the <br /> Commission. <br /> Mrs. Simmons asked if the name on the plan had been resolved. <br /> Mr. Sanicki stated the property changed brands two times, with research at the <br /> Registry of Deeds and an order from the registry, the owner of record is shown. <br /> Mr. Sherman advised when he went to the site when the tree was being cut down,, <br /> the crew told him Mr. Regan directed them to cut down the tree and the assumption <br /> was that Nor. Regan owns the property. <br /> Nor. Sanicki stated it is now up to date to the best of his knowledge. <br /> 1s Beh man expressed concern with the seed lawn on the landscape plan, between the <br /> deck and santuit Pond, as the bark is very steep. She pointed to the trees in- <br /> dicated on the bank and stated the implication is there is going to be more <br /> clearing. <br /> Mr, Sanicki stated the end of the seeded lawn towards the pond area would have <br /> been the work limit which had been disturbed and trees cut. The proposal through <br /> Barnstable Folding Company is to reseed that section that has been disturbed, if <br /> the Commission desires that this be revegetated in an alternate means, he requested <br /> this be done in the order. <br /> Mr. Sherman stated there should not be seeded lawn in front of the deck. <br /> . <br /> In answer to a question, Mr. Sanicki advised the fill is within the ,jurisdiction <br /> of the Commission. <br /> Ms Behrman agreed the proposed driveway is an improvement on the former driveway, <br />
