Conservation commisssion <br /> November 30, 1989 <br /> Page 9. <br /> Ms Behrman asked the depth 20 ft. away from the float. <br /> Mr. Hayes stated there haven't been any boats in there to carve out the bottom. <br /> Mrs. Simmons asked the kind of vessels and horsepower that will be moored at <br /> that float. <br /> Mr. Mayes will consult Mr. West. <br /> 1s Behrman asked, a s this is Jeh u Pond, is this something that requires an <br /> Environmental Impact Report for the State. <br /> Mr. Sherman stated if in Jehu Pond it does. <br /> Mr. Mayes stated it is, but it is a pre-existing structure that they agreed to <br /> remove the fixed to make it a float. <br /> Ms Behrman stated the requirement for an Environmental Impact Report has been in <br /> effect for three years, at least. The initial perryissiori, just for the stairs , <br /> received an order of conditions on January 13, 1985. The ramp may have been <br /> there but was very recent and was not protected by a pre-existing structure. <br /> Long before this order of condi tons was granted the state was asking for ars <br /> Environmental Impact report and that will have to be complied with. <br /> Mr, Hayes asked if she was saying she wanted to see an E I for a 201 X ' float? <br /> oat? <br /> Ms Behrman stated the Commission is not asking for that, the State is asking ng for <br /> that. The Commission can grant ars order of Conditions but the State is going to <br /> ask for that. <br /> Er. Sherman advised the Commission should not grant an order until that has been <br /> resolved* <br /> Mr. Mayes stated it was his understanding that as long as performance standards <br /> were met, as addressed in the Notice, the EIR wasn't absolute. <br /> Mr. Sherman suggested he resolve th i s and get back to the Commission. <br /> Mr. Hayes asked if small dinghies and non-notarized craft were included. <br /> Ms Beh man suggested he contact the state. The Commission can't condition future <br /> use; a structure is a. structure. <br /> Mr, Hayes stated there def i n i to lwill be a. power boat there. He stated h could <br /> appreciate �r thposition V Commission.V ommis ion. <br /> 0 <br /> Ms Beh rman felt the float i s enormous in size. <br /> Mrs. Simmons asked hire to ascertain if in one piece or two and to consider a <br /> reduction in length. Mr. Hayes agreed. He asked if they should go out 50 ft, <br /> on each of the float for the soundings? <br /> Ms ehrman stated generally it's at least the length of the property. <br /> Mrs. Simmons asked Nor. Hayes if there were any structures on either side and was <br /> told there are a lot of structures out there. She stated i f there are adjacent <br /> lots they should be noted with the distances. Mr. Hayes agreed but stated , from <br /> a trespass standpoint,, they will run the lines out and give an approximate distance <br /> as well as- contour depths. <br />
