Simmons questioned the size of the float on the plan and was told 6 X 18.6. <br /> Mr. Somerville did not agree with the shellfish designations on this. He pointed <br /> to what he felt was shellfish habitat. He suggested a notation be included that <br /> he d i d not feel it was representational of the shellfish. He agreed to provide <br /> the Commission with a comment. <br /> Gerald Umina,, ars abutter, advised he attended the Appeals Board hearing in opposition <br /> not so much to the pier as to the placement, He presented a copy of the letter he <br /> has sent to the Appeals Board after receiving notice the permit had been granted. <br /> Mrs. Simmons advised this is not under the jurisdiction of the Commission. <br /> Mr. 11 i n a stated he d i d not feel the Commission could render a decision with h i <br /> appeal still pending with the Appeals Board process. <br /> Ben Lofchie, president of the association, advised the Appeals Board stated this <br /> has to go through court; the Appeals Board has passed this. <br /> Mr. um i na stated there seers to be some misinformation, he spoke with the Town <br /> Clerk and was told that this would be sufficient. <br /> Mrs. Simmons suggested he follow it up with the Board of Appeals and thanked hire <br /> for bringing it to the Commission' s attention. The Board of Appeals will be con- <br /> tacted. <br /> on - <br /> tted. <br /> Mr. Coffey asked i f this is within oo feet of the Torn/State ramp, is it a hard- <br /> ship <br /> ard-- <br /> ship to use that ramp <br /> Mr. Umina stated he uses that other ramp and this one also, a lot of other people <br /> do. Even th ougfh the association has title to this property, everyone in the area <br /> has the night to use that green area and the ramp. He doesn't feel a handful of <br /> people should be able to take this right away. <br /> Mr, Coffey asked if he realized it was the Commission who started the problem and <br /> that this is an environmentally sound answer to what was there before? <br /> Mr. Umi na started he understood that from a conservation standpoint it is great, <br /> his stand is that they are taking away the use of the land and he doesn't want to <br /> see that happen. <br /> . Desrosie rs asked if the dock had been built and Mr. Gauthier gage the back- <br /> ground <br /> ac - <br /> round of the filing. The dock is sitting ori the lot. <br /> Mrs. Simmons pointed out it is a float. They had permission for a float and <br /> then they put a ramp from the land to the f l oa which brought it under; the Comm- <br /> ission' s ,jurisdiction. <br /> Mr. Coffey added, and put up ar sign earlIing it a dock. <br /> Mr. Sherman stated Mr. limina is correct. If this hasn't received clearance from <br /> Board of Appeals, which he will check, under the act the Commission has no Juris- <br /> diction but Chapter 91 may have jurisdiction under public access. <br /> Mrs. Simmons suggested closing the hearing after changes are rude on thep larn and <br /> information received from Board of Appeals. <br /> CONTINUED To JANUARY 11 , 1990 - 8: 15.
