Conservation Commission <br /> 20 January 1994 <br /> Page 4. <br /> Mr. Sherman stated a sketch plan would berms for near the utility boxes and near <br /> where the Red Cedar was knocked over. Mr. Hayes suggested some white Pines and <br /> Hemlocks in there. Mr. Sherman asked if they could put in some larger items? <br /> Mr. Hayes agreed., a couple of red pines along the front. <br /> Mr. Sherman stated until some ground cover is established, he is concerned about <br /> keeping haybales up to prevent penetration into the vernal pool, where Red Brook <br /> turns the corner. Mr. Mayes suggested he provide the Commission with Chief reports <br /> as he did on the revetments; a bi-monthly five line report. Sketch plans will be <br /> provided for the two areas. <br /> Mr. Desrosiers stated he would like to see better discourse between town groups. <br /> Mr. Homeyer asked how they would service the utility boxes and was told there is <br /> an asphalt drive to the boxes. <br /> Public comments were requested; none. <br /> Vim: Motion made and seconded to close upon receipt of a design plan for the two <br /> areas discussed and a monitoring schedule. Unanimous vote. <br /> M <br /> TO CLOSED. <br /> 7:50 LUC D, MI for for a Determination of Applicability on the delineation <br /> of saltmarsh boundary at 190 and. 194 Monomjoscoy Read. Mrs. Misurella advised she <br /> had the flagging done professionally, <br /> Mr. Sherman advised they approached him about this to get justifiable relief from <br /> requirements in order to establish that it is unbuildable. Brad Hall was hired to <br /> do the delineation and distances are accurate. It would not be possible to build <br /> anything. The flags are accurate and the Commission would make a Determination to <br /> that facts- 4 <br /> Public comments were requested; <br /> Robert Delory advised he owns the marshland and was not notified for the hearing. <br /> He stated the Com fission is going to establish his property lime; he owns the wetland. <br /> He has not had a chance to see what was flagged. <br /> Mr, Sherman advised notification is only necessary in the newspaper for Level 1 <br /> fi l Ings. <br /> Mr. Delory stated the Commission could have a taking. <br /> Mr. Desrosiers -stated all of•Mr, Delor y's comnments are not, germ ain to the issue. <br /> Mr. Sherman stated-. this has nothing to' do with property lines, <br /> Mr. Delory stated a number of years ago, that wetland that he had there, extended <br /> a lot further .into the marsh. He has picked up two rerods;k someone was cutting off <br /> the marsh and theresults can be seem at low tide. <br /> 14r. Sherman suggested the ,Corm s s i on could state in"the De t e rani a t .on that they <br /> accept the wetland lime Which has n thing to do with property rights. If Mr. Delory <br /> takes exception, he can appeal. <br /> Mr. Delory asked for a copy of all correspondence the Commission has regarding <br /> this case. <br />
