Mr. Sherman stated he would say they can have a pool but condition that there will be no encroachment into the 50 foot setback. Ms Lamik asked how that would be possible where the pool is set now? Mr. Grotzke stated he could move it back and shrink it. Mr. Fitzsimmons was not pleased with the presentation, with Bloom, Mr, Grotzke came in with a full plan. Mr. Sherman stated the Commission could issue a Negative Determination lased on the fact there would be no encroachment into the 50 foot NVBS; no alteration at all. Mr. Fitzsimmons added, and no tilting. Public comments were requested: none. VOTE: M tion made and seconded to find a Negative Determination with the condition that there will be no encroacement whatsoever into the 50 Foot buffer strip and no alteration at all. Unanimous vote. NEGATE WITH CONDITION. 8:10 OTIS ANG , Installation Restoration Program for a Determination of Applicability on the installation of borings/piezometers at various locations along Grafton Pocknet Road in Mashpee. The Request was withdrawn by the applicant as the project is not going forward. WITHDRAWN, 8:20 .
