Mr. Allenby stated he has spent 40-50 gears in the business. <br /> He made inquiries today and no other Board on the Cape has <br /> this requirement. <br /> Mrs. Ferriday stated each Board has its own policy. With <br /> this Board, vista pruning is permitted after the growing <br /> season; this is a policy the Commission has adopted. Many <br /> professionals have not objected to this,. <br /> Mr* Allenby will advise firs. Keene to seek a tax abatement <br /> and to appeal to DEP which will take more time. <br /> Mrs, Ferriday stated it 's not the Commission's concern; <br /> Mrs, Keene has allowed this to be overgrown, they have to <br /> limit it to environmental concerns. <br /> Mr, Allenby asked ghat is the concern and was told it is <br /> habitat. <br /> Mrs. Ferriday asked if he would like to bring in an expert t <br /> certify that the area is devoid of wildlife habitat but Mr, <br /> Allenby stated that would take too much time, She stated if <br /> ho refuses to agree to the condition on timing, the <br /> Commission will have to find a po hive determination. The <br /> end of October is the end of the growing season. <br /> Ms Lannik stated there is no reason to change policy in this <br /> instance; there is justification to bold to that policy. <br /> Ir. Allenby stated there is no difference between pruning and <br /> vista cutting. <br /> Public comments were requested: none <br /> Ir* Desrosiers stated aftr 'what has happened here, he would <br /> be willing to find positive. <br /> Mr. Sherman stated the Commission could issue a negative <br /> determination with the condition the work not be done, only <br /> within the time frame, which would have to be recorded. The <br /> Agent would have to be notified when the job is started. <br /> Mr. Allenby asked ghat about the big trees he wants to vista <br /> prune? Mr, Sherman stated those trees off the bank could be <br /> conditioned to be done now. He would meet with Mr. Allenby <br /> to determine the ones that could be done. <br /> VOTE: Motion 'made and seconded to find a negative <br /> determination with the condition that none of <br /> the pruning, except for those not on the bank, <br /> be done other than from the end of October <br /> through March* The Agent will work closely <br /> with these people. <br /> NEGATIVENITH CONDITIONSO <br />
