Mr. Fudala advises there is no way to require bonding for <br /> that type thing. Any time there is open space, under state <br /> law and the bylaw there has to he a deed restriction that <br /> this land will never be developed. <br /> Mr. Desrosiers asked ghat would prevent this being sold to <br /> abutters. <br /> Mr. Fudala advised it can only be owned by a town recognized <br /> land trust. Only in one case has that been violated. There <br /> .is no legal process for keeping track of deeds. It will be <br /> in that special permit to file with the town within six <br /> months. There are lot covenants. <br /> Mrs. Ferriday stated in #19 she would like to see "encourage" <br /> changed to "require" . Mr. Fudala stated there is no <br /> authority to require. Mrs. Ferriday stated the same would <br /> apply to 2 . <br /> Mr. Fudala stated this is a draft; whatever* the Commission <br /> wants changed, he will change. It makes him nervous to use <br /> "require" with the chance to have it voted down at Town <br /> Meeting, He would not want to create controversy. The <br /> Commission agreed. <br /> Mr. Homeyer asked if he was suggesting culverts under the <br /> road in Mr. Fudala had nothing specific in mind, it <br /> would depend on the animal. <br /> This plan will go from the Commission to the Planning Board <br /> and ultimately to Town Meeting. On wetlands/Wildlife & Plant <br /> Habitat, Mr. Fudala stated he would like a vote on the <br /> record. <br /> Mr. Sherman referred to policy #9 and stated he sees a drift <br /> at state level re mitigation banking. He asked if this <br /> polio is not intended to facilitate mitigation banking <br /> Mr. Homeyer stated it definitely states restoration, not <br /> replication. <br /> Mr. Fudala stated this would not involve mitigation for <br /> destruction and degradation of other wetlands. He suggested <br /> he and Mr. Sherman can come up with some wording. <br /> VOTE: Motion made and seconded to accept Wetlands & Wildlife, <br /> Plant Habitat - Goals & objectives, subject to the <br /> Agent and 'Town Planner working out the language changes <br /> discussed tonight. <br /> OPEN SPACE: <br /> Mrs. Ferriday -asked that municipal revenues be clarified in <br /> VI U 31 <br /> Mr, Homeyer stated there was a vote to get out of the <br /> i <br /> cranberry business that was never rescinded. <br /> Mrs. Ferriday stated the consensus of the Commission has <br /> changed; if he wishes to rve it, he may do so. <br />
