Jonathan Burtis said it would be better to have an <br /> 81 x 201 float, There are three changes from the original <br /> submission. New plans have been submitted to Chapter 91, <br /> ACCE, Shellfish and Harbormaster. <br /> Mr. Sherman stated there is a complication he has discussed <br /> with Mr. Foley. An amended order could be issued if there is <br /> no problem with Shellfish but part of the dock is over town <br /> property. He has been pressing the Executive Secretary on <br /> how to handle this issue. <br /> Mr, Foley stated he was advised an opinion is expected from <br /> Town Counsel within a wee} . <br /> Mr. Sherman stated the Commission could provisionally pass on <br /> this but would need a release from Mr. Foley for doing beyond <br /> 21 days. <br /> Mr. Homeyer asked if this is an old pre-existing dock and was <br /> told that it is. <br /> The Chairman asked, assuming the land easement can be <br /> straightened out, what is the consensus of the Commission? <br /> The consensus was to accept the amendment, that it was <br /> acceptable. A formal vote to be taken when word is received <br /> from the Executive Secretary. <br /> i <br /> Public comments; none. <br /> Motion made by Mr. Homeyer to close the hearing pending <br /> advice from the Selectmen on Town Counsel's opinion <br /> regarding crossing over town owned land. There was no <br /> second. <br /> VOTE: Motion rade and seconded to close the hearing <br /> pending Town Counsel's opinion and a report from <br /> the Shellfish Warden. Mr. Homeyer abstained. <br /> CLOSED PENDING. <br /> 8:00 WALTER SPENCER WIGHTMANs 419 Monomoscoy Road, continued <br /> from January 19. <br /> The Agent advised they have requested to continue to March <br /> at : 00 in order to revise their plan.
