- 12 - <br /> Public comments: none. <br /> CONTINUED TO 13 APRIL 1995 - 8:00 P.M. <br /> RESIGNATION: Letter received from Dan Homeyer was circulated. <br /> Mr. Sherman was concerned that it left the impression the <br /> Commission was breaking the law. The consensus was that the <br /> letter did not deserve a reply. <br /> The vacancy has been posted. The only person who has <br /> responded is Joe Rintone. <br /> Reorganization is necessary. To be discussed next agenda. <br /> Mrs. Ferriday advised Mr. Rosenberg will give an answer about <br /> stepping up next hearing date. <br /> Mr. Desrosiers was asked if he would consider taking chairman <br /> again but he declined due to a family health situation and a <br /> possible work transfer to Tewksbury. <br /> SPECIAL CONDITION: Distributed for review. This was <br /> occasioned by the situation with South Cape Beach State Park. <br /> VOTE: Motion made and seconded to accept and add Special <br /> Condition 71 (A) to all Orders of Conditions <br /> henceforth. <br /> NCD: Revised penalty schedule distributed for review. <br /> 310 CMR 10:55: New BVW regulations distributed to be inserted <br /> into the reqs. They bring in figures and hydrology. The <br /> Agent would like to review the bylaw freshwater regulations. <br /> #3 : The main change is if a consultant wants to give soils <br /> evidence, the Commission has to take it. The Agent would <br /> like to not have that consideration in the freshwater reqs. <br /> He will work this out with Mr. Rosenberg along the lines that <br /> the Commission "may" accept it but are not obligated to do <br /> SO. <br /> NVBS: A copy of the Andover decision was distributed for <br /> review. <br /> ATV'S: The Agent discussed with Joel Lerner from EOEA the <br /> use of ATV's on town owned land. He is dead-set against it. <br /> He gave the Agent the language from MACC. <br /> To be discussed with Mr. Green present. <br /> Mrs. Ferriday suggested sending a letter to the Selectmen to <br /> see what other town-owned land might be suitable. <br /> MIKE MIRTO: Opinion received from Town Counsel . If under <br /> $1000 it is not a problem. The problem is how to put a <br /> dollar figure on it. The way it was proposed, he did not see <br /> how it can be done. You would have to know the board feet. <br />
