- 4 - <br /> Mr. Hayes pointed out that the Commission did not require <br /> Mr. Cariglia to remove his grout. The Agent stated maybe it <br /> should have been required. <br /> Mrs. Ferriday stated if Tide Watch comes before the <br /> Commission with a plan for annual maintenance, they would <br /> want to know the status of the entire revetment. <br /> Mr. Hayes agreed they can do that and address the issue with <br /> Rebecca Haney. They had to file an ENF and CZM gets <br /> involved, but the grout is above their jurisdiction line. He <br /> will try to bring to the table all the issues. <br /> Mr. Sherman stated it would take a lot to convince him that <br /> the grout should not be removed. <br /> Mr. Lopez asked if it can be removed on the outside while <br /> leaving it on the inside? Mr. Hayes stated it can. <br /> Mr. Sherman asked if the contractor should be fined for not <br /> following an Order of Conditions; this is not the first time, <br /> it is the sixth. <br /> Mrs. Ferriday read from previous minutes where the Commission <br /> agreed to send a strongly worded letter. She would support a <br /> fine. <br /> VOTE: Motion made and seconded to issue a fine to Bonito in <br /> the amount of $100 for disregarding an Order of <br /> Conditions for the Tide Watch revetment. <br /> Mr. Rosenberg suggested setting up a schedule. He asked if <br /> it would be appropriate to require each year, by March 1 , a <br /> proposal of what will be done there for a continuing record <br /> of action being taken each year? Mr. Hayes agreed. He <br /> further advised that the beach nourishment put down was gone <br /> in two tides. CONTINUED TO APRIL 27, 1995 AT 7:30 AT THE <br /> REQUEST OF THE APPLICANT. <br /> 7:50 ROBERT E. LEE for a septic system upgrade and dwelling <br /> addition at 28 Jeep Place. Dave Sanicki presenting. Abutter <br /> notification receipts were provided. The house is existing <br /> on the bluff. The property line goes across but he does not <br /> own the embankment and down; this belongs to Christopher <br /> Burden. They are upgrading the septic to Title V for four <br /> bedrooms. Hedges have to be removed for the addition. They <br /> are increasing the kitchen and family room area. Work limits <br /> are proposed. Siltation fences will be maintained. The <br /> septic system has been approved. <br /> Mrs. Ferriday stated it is very flat; there should be no <br /> impact. <br /> Mr. Sherman had no concerns except for erosion control. <br /> Public comments: none. <br /> VOTE: Motion made and seconded to close the hearing for <br /> Robert E. Lee. <br />
