A ren Haler letter sent and response
received. They must maintain the Piping Plover intern plan.
b&. Desrosiers statcd they are no longer endangered.
hr. Sherman referred to the third paragraph that tabs about this. He suggested a letter be
sent to them noting that and asking to be informed of the progress but indicate that the
Connnission expects there to be an intern.
WORKSOP: Cape & Islands Tune Stabilization workshop to be held on 3/13/96 at
9:00 am. by Deal Conservation Districts. John Johansen, Kathy Terrio and Harry
Iesrosiers to attend.
JESSICA & PETER AUE: Mr. & Mrs. Laue awed at 7:1.o p.m. and asked to be
heard. The Agent had expected therm to be present at the public comment pc&d.
The Chainuan stated that, on the Agent's recommendation, they would be heard but there
was a hearing scheduled for 7:05 and that there was three minutes available to thern before
the next meeting.
Mrs. Laue asked if he was volunteering them three minutes? He stated the Commission
would heat' them but will have to call the next hearing as scheduled. He stated they could
have more time as it became available. Mrs. Laue distributcd written material to the
Commissioners. One item was a letter from the realtor from whom they purchased the lot.
She worked closer with there; she has been a reltor for 39 years. She spoke with her
yesterday and today and she has notes about Mrs. Laue meeting with lfr. Sherman and
discussing this lot with Bill Hauch and Elias McQuaid before the lot was purchased
because, as she said before in a letter, they would have never purchased this lot if there was
going to be any type of problem with it. She said that she would sign a sworn affidavit
about her knowledge of her meeting IIx. Shennan at the lot and telling her that there
wasn"t any problems with wetlands. Also, she included a cost analysis of what these
problems are going to cost than, money that they have already spent and money they wl
spend if#his is indeed a wetland.
h&. Laue stated they gent ahead with Mr. Sherman's assurances of no jurisdiction of the
Conservation Commission. That was then reinforced by the issue of a valid building
pernnit and every single official in the Town has told us that no building permits are ever
issued without all departments signing off. So, they had assurance that 1 Ir. Shenlaan had
signed off. This funned out not to be the case and two weeks ago they were rudely
swpriscd by being accused of violation of the wetlands Act. Nodiing he has clone on this
property is in violation of anything, as long as there are no wetlands, which they were
r
