20 February 199 <br /> Page 5. <br /> VOTE: Motion made and seconded to close subject to conditions set forth <br /> with respect to stripout, receipt of DEP number and that three of <br /> the tanks on the slope be f&ed rather than removed by hand. <br /> Unanimous Vote. <br /> CLOSED SUBJECT T . <br /> 8:20 PHYLLIS NEWCOMB to permit an existing stairway on an inland <br /> bank and removable dock, removal of an existing platform, and a request for <br /> maintenance in perpetuity at 198 Pimlico fond Road. Mrs. Newcomb <br /> presenting. <br /> dw <br /> Aft. Sherman stated Mrs. Newcomb has been working with him. It is an older <br /> structure with no permitting. The platform is over a vegetated wetland. <br /> There is no engineered plan but the wetland line is located on the play.. Mrs. <br /> Newcomb agreed the Commission could inspect after the platform is removed <br /> to determine if plantings aro necessary. <br /> Public comments: none. <br /> VOTE: Motion made and seconded to close pending receipt of DEP number. <br /> Unanimous Vote. <br /> CLOSED PENDING. <br /> :30 TUC R SPOHR to amend the Order of Conditions for SE -1500 <br /> under Chapter 172 of the Mashpee Coco to coincide with the Department of <br /> Environmental Superseding Order for 29 Hamblin Road. <br /> Mr. Sherman advised the superseding Order from DEP required an as-built <br /> plan and erosion control. Past policy has been to hold an amended order <br /> hearing and mirror the superseding order. Their attorney made the point that <br /> it would open them up to another appeal. Before any Certificate of <br /> Compliance is issued, all aspects of the DEP superseding order must be <br /> satisfied and a letter stating same provided. They have withdrawn the <br /> amended order request. The letter to be passed on to any new owner. <br /> Mr. Rosenberg agreed. <br /> Public comments: None. <br /> Mr. Sherman advised he has written a boilerplate condition because of this <br /> order. <br />
