1 May 199+7 <br /> Page 5. <br /> Mr. Jones, an abutter, was concerned with the proximity to his float and also, <br /> for the two great herons that take refuge there. It is 51 feet from his float. <br /> Mr. Sherman stated this cannot be addressed under the wetlands Act. <br /> It was agreed all issues are Board of Appeal issues. <br /> Mr. Sherman concurred. with Mr. York that it should be moved out. He <br /> referred to a Cedar tree on site and asked if this will miss it Mr. S anlcl i <br /> stated it will not interfere. fir. Sherman suggested meeting out there again <br /> to view this with N1r. S anicki. <br /> VOTE: Motion made and seconded to continue the hearing to 15 May 1997 <br /> at 8:00 p.m. at the request of the applicant. Unanimous Vote. <br /> HEARING CONTINUED TO 15 MAY 199+7 AT :00 P.M. <br /> 8:10 CHARLES MA1 Z T to construct a dwelling, septic system, driveway <br /> and landscaping within Zoo feet of Dutchman's Brook at 23 Mead.owbroo <br /> Road. Chris Costa presenting. This lot is partially in the flood plain. Behind <br /> the lot is Dutchman's Brook and this comes under the two zones of the livers <br /> .pct. Also, the BVW line is shown o- o' wide which was flagged by weteh. <br /> Under present guidelines, they are constrained to only develop 5000 s.f of the <br /> area with which they are more than complying. It is a two bedroom home and <br /> the lifnit of work is 10 feet from the house to male the 5000 s.f. guideline. <br /> They are 199 s.f. over. In the front of the house is a lawn area in the location <br /> disturbed by the septic. They have met ah. setback requirements and no work <br /> is proposed on the near riparian zone. Three or four plants to be put in if <br /> necessary to mitigate the 190 s.f. overage. <br /> Mr. Sherman stated the Commission cannot issue until Board of Health <br /> approval is received.. <br /> Mr. Johansen stated DEIN number is missing, attestation of ownership also. <br /> Abutter receipts were provided.. It will be conditioned that architectural plans <br /> will be provided. <br /> Public comments: none. <br /> VOTE: Motion made and. seconded to close subject to Board of Health <br /> approval, submission of Boor plans, DEP file number and <br /> attestation of ownership form. Unanimous Vote. <br />
