29 May 1997
Page 9.
The Chairman called for public comments and asked that they have one
spokesperson for the group present.
Leonard Lauer, President of the Village Association, advised they had three
people who wished to speak. The Board's opinion reflects the majority of the
neighborhood and it is that the 50 foot conservation zone should be preserved;
that is their position. They are concerned with the work area shown. The
earth is going to have to be removed down 10 - 12 feet to pour the concrete
wall for maneuvering room. He asked where the dirt is going to be placed?
Mr. Grotzke stated concerning the house on Tide Run, the Assessors sheets
show they had variances. He took offense to remarks from the Association
implying that he was doing something in error. He did this with great
caution. Concerning the excavated fill, they will dig down 4 feet below grade
and it wi1l be stockpiled upland of the work hit.
Joanne Fox wished to speak to the size of the house in relation to the lot and
the properties on 'fide Run. She had the Assessors sheets with her for
information. There are 30 houses, 6 over 2275 s.f., 17 under 2275 s.f. There
are 7 houses close to 2200 s.f. There -are 30 houses on the road, 14 with
garages. Most of the homes are not as large, footprint-wise.
Mr. Charles of Topping Lift stated the point is the applicant has the burden of
proof to show it is impossible to put a normal type house on the property
without encroaching into the Conservation zone.
Howard Glaser stated there is a maximum amount of space that can be used.
They wanted to drive in to the garage, out of the weather. There is a lot of
work in the area that residents are unhappy with. This is the last lot to be
developed. The roadway has encroached on the wildlife more than their home
will. Also, they want to be able to live on the first floor and do not want
bedroom on the second floor.
Mr. Charles stated they are trying to pint 10 pounds into a 5 pound bag.
Mr. Lauer stated every time Mr. Grote speaks, he tries to mislead. He
asked if they would give an easement for village landscaping.
Mr. Grotzke stated they made every effort t . . e the house, it has
gotten smaller. He stated the Commission does consider variances. They
have zoning variances and setback variances. if dealing strictly with the
state, they would aRow this.
