He did a notice of intent to put in a gabion wall <br /> which was satisfactory and was then given a waiver to not put in the gabion <br /> wall because the portion of land is a right of way and is in contention between <br /> he and a group of neighbors as to who ovens it. The <br /> Commission has always required an engineered plan under Chapter 172. <br /> Mr. Rosenberg stated he did not think the Commission can waive it.
