He did some illegal alterations to the coastal bank <br /> and was ordered to correct. He did a notice of intent to put in a gabion wall <br /> which was satisfactory and was then given a waiver to not put in the gabion <br /> wall because the portion of land is a right of way and is in contention between <br /> he and a group of neighbors as to who ovens it. He was given a time extension. <br /> In the i aterim the storms this summer have taken away the small stairs that <br /> were there and W. Smith has added a board, which he should not have added. <br /> The lawyers for the aggrieved parties wants the Commission to order the <br /> stairs replaced. <br /> Mr. Rosenberg stated the Commission has no authority to order him to do <br /> anything. Mr. Sherman stated if nature takes it away, we have no authority <br /> to compel a person to put it back. Mr. Rosenberg said we could not do it even <br /> if he took it out himself. They gill have to go to court to get him to do it, this <br /> is not up to the Commission, unless he took stairs out . that caused <br /> environmental damage. Mr. Sherman stated it doesn't, the stairs are better <br /> off gone in terns of the effect on the beach. A response to be crafted. <br /> Fulton: Letter was received from. Mary Brown, attorney for Mrs. Fulton, re <br /> her putting a clod off of Monomoscoy Road. Mr. Sherman stated there has <br /> not been a clad there and Perry Ellis does not remember one being there. Ms <br /> Brown has asked for a waiver for not doing an engineered plan. The <br /> Commission has always required an engineered plan under Chapter 172. <br /> Mr. Rosenberg stated he did not think the Commission can waive it. Mr. <br /> Sherman advised dock policy states it is at the CommissioWs discretion. <br /> VOTE: Motion made and seconded that the Commission not wave policy with <br /> respect to Elizabeth Fultoes request.
