When clean copies are received , the Commission's regulations will <br /> be fine-tuned. EDEA has regs for how they defined the densely developed <br /> areas. The Agent had asked. Mr. Rosenberg to review them and they put new <br /> language in that any to acre parcel on the riverfront, with a couple of <br /> conditions, either a 20 unit building or 3 residential buildings on 2 acres, could <br /> be declared a densely developed area and the IPPA applies only to 25 feet, not <br /> Zoo feet. In summary, it turns out that the process requires the petition to b <br /> made by the Selectmen with concurrence of both the issuing authority, <br /> defined elsewhere as the Conservation Commission and Planning Board. We <br /> have a veto. <br /> Water Supply Permit: Mr. Rosenberg advised he spore with Lleldon <br /> Langley and he recommended that the Commission be the Agency applying <br /> for the water supply permit. He raised the question of possible liability if <br /> there were violations and he pointed out there could be only thing which could <br /> be a violation and that would be a failure to file reports. It is Mr. osenberg's <br /> recommendation that the Commission file for the water permit, that will not <br /> necessitate going through the procedure of changing in the event operators <br /> are changed. He has not seen the leases, but would strongly recommend that <br /> the lease contain a clause that provides that any failure to fie reports or to <br /> operate within the terms of the water permit, p art of the lease to him, is <br /> grounds for termination of the lease. Any renewal of any cranberry bog leases <br /> must contain the language which allows termination if there is any violation <br /> of the terms of the permit, including any failure to file hely reports. It <br /> should be "due cause" and it should be up to the Commission whether to <br /> terminate. <br /> Lleldon recommended, and Mr. Rosenberg agreed., that from now on the <br /> Commission make the application. <br /> Fish Run rehab: The ladder on the north side 'is complete. It is intended to <br /> start work on the lower fish ladder. The giver will have to be shut off for one.- <br /> haH day during the next few d yra. Vhon the anil ir. put bad in place it will <br /> have to be covered with erosion control blankets and some seed thrown down. <br />
