Norman Hayes presenting. <br /> Mr. Sherman asked if the location of the house was changed from the original <br /> Plan? It was, Mr. Hayes advised the house is out of the 50 feet, only a small <br /> portion of the deck is in. Mr. Sherman stated it is almost to the 35 and on this <br /> lot there is more fleib' 'ty to move it back. <br /> Mr. Stone stated he has a fear of the road with the speed that the cars travel <br /> and that is why he is trying to keep the house back from the road.. <br /> Mr. Mayes asked., if he can show the Board the eminent domain takings were <br /> for X amount of square feet and actually double X amount of square feet was <br /> paved, would that make a difference to the applicant? <br /> 1r. Rosenberg asked if he was saying that there is pavement on the client's <br /> land? Mr. Hayes stated it is. <br /> 11r. Sherman stated that issue would have to be adjudicated with the town. <br /> Public comment: none. <br /> VOTE: Motion made and seconded to continue the hearing at the request of <br /> the applicant to 5 February 1998 at :20 p.m. Unanimous Note. <br /> HEARING CONTINUED 5 FEBRUARY 1998 AT :20 P,1 , <br /> :30 LEWIS HADELAIAN to construct a residence, deck, driveway, water <br /> service, sewage disposal system, filling of a portion of sand borrow area, <br /> re a etation and terraced walkway at 35 Punkhorn Point Road. Dave Sani ki <br /> presenting. It is proposed to bund a dweg and when excavation takes <br /> place, the fill will be placed in the borrow area. They will revegetate the area <br /> along the embankment. The tiered walkway wiR access the open space. Out <br /> of the work area will remain natural. The septic is beyond the loo feet. He is <br /> showing 172 which is 1 foot higher than the State. He drew this lime with red. <br /> Mr. Sherman stated the leaching is still within 100 feet of the bank. Mr. <br /> Sanicki stated the top of bank would have been different before used for <br /> agricultural purposes. <br /> Mr. Sanicki will provide a revised plan with the septic at a different <br /> orientation. <br />
