This home is next to a small grove of black pine
and she would like to put a small swimming pool there. To compensate for the
removal of the trees, they propose to upgrade the vegetation between the pool
and retaining wall. There was a previous filing approved to restore and
rebuild the retairning wall. They would like to finish the garage upstairs an
add a bedroom. They are proposing a four bedroom denitrifying septic system..
The salt marsh is below the retaining wall and is 14' or so from the pool apron.
t
It was noted Langbert was the owner of record at the time of filing. ,
Mr. Sherman stated, according to the bylaw, the Commission tries to
maintain a 50' setback between any adjacent resource areas and the area of
disturbance. In some cases that can't be done, as with houses, so the
Commission has gore down to 35'. However, at other times, if mitigation
proposed makes it a better situation than it was, vis-a-vis runoff or ildfe
habitat, the Commission has gone down less. In this particular case, even
though the area between the black des is basically no vegetated with any
undergrowth, it std has wildhfe habitat value. He asked Mr. Grot ke if it is
possible if the revegetation plan was accepted, and the species chosen were
appropriate, could he move the pool back a little bit because there are two
driveways. Mr. Grotzke stated pools are subject to setbacks as well.
Mr. tarot ke stated the retaining wall is like a bulkhead for the coastal bank.
1r. Sharpe asked how high above the level of the ground it is Mr. Grotke
stated it is about T.
Mr. Green asked if they had looked at any other locations? Mr. Grotke
stated they could rotate this which would give therm another 5 feet.
Mr. Sherman stated for the Commission to waive the regulation, the
Commission should get a commensurate area of revegetation that is the same
as the area of the pool. He asked if this had to go before Board of Appeals?
