Nor. Sullivan stated the waters of the <br /> Pond are the property of the inhabitants of the Commonwealth, and <br /> as such, require a C. 91 license. He asked if it is assumed a <br /> C. 1 license exists on the Pond, or has one actually been found, <br /> and if so, are there particular Conditions within the Permit; or <br /> is the Pond subject to rill Pond regulations, whereby the <br /> Conditions for the spillway are stated within the Permit . <br /> Mr. Bliven responded that his investigations resulting in <br /> compiling information for this Report through BEP and the Dain <br /> Safety Division within the Department of Envirorunental management <br /> indicated no C. 1 licenses for the construction of the spillway. <br /> There was a partially completed C. 1 license for the construction <br /> of the jetties located adjacent to the spillway. Mr. Blaen <br /> stated that to the best of his knowledge, there are no existing <br /> C.91 licenses for the Pond/water control regulatory structures. <br /> Mr. Bliven further reported there is a license from DEP for the <br /> removal of water for the purpose of flooding cranberry bogs. One <br /> of the reasons for recommending an as built-plan is to have the <br /> information should BEP request it, and to avoid any future <br /> inquiriLas about the nature of the spillway. <br /> 1 <br /> Nix•. Sullivan asked if the property should be placed under an <br /> existing valid legible C, 1 license for historic purposes . <br /> Mr. l lven ' stated the DEP is aware of the Notice of Intent, <br /> they have indicated that a license is required for a pond <br /> lowering effort, and that this being a situation of stabilizing <br /> the Pond within historic fluctuations appears to be acceptable. <br /> Mr. Sherman noted that comments are generally stated on the <br /> BEP Notice of Number, which has not yet been received. <br /> Donna McCaffrey inquired about using a staff gauge to check <br /> the elevation of the Pond.
