23 July 1998 <br /> Page 3 <br /> Mr. Rtz mons stated he is a neighbor and asked if there were any <br /> concerns for him sitting on this application? Mr. Champion had no concerns. <br /> Mr. Sherman advised Diane Boretas found otters down at the edge of the <br /> Pared. She suggested as the steps are replaced, it be restricted to four foot <br /> wide and because the existing path is wider, outside of the 4' dimension of <br /> the steps that it be allowed to grow to a height of 18" an either side of the <br /> path. Also, because of the use by animals, she suggested moving the <br /> platform back 25'from the edge of the pond. <br /> Mr. Champion stated there has been a lot of construction, one house has not <br /> only a deck but a dock into the pond. <br /> Mr. Sherman stated the Commission will not compare this project to any <br /> others. He felt Ms Boxetas suggestions were sound. Platforms into the first <br /> 54' are not normally permitted. <br /> Mr. Green asked the purpose of the platform? Mr. Champion stated it is a <br /> deck to sit on. He stated he could accept the 25' setback and asked if it could <br /> be from the average level of the pond? <br /> Mr. Sherman stated that could be considered but there will be an on-site <br /> before it goes in to determine that. W. Champion was willing to make the <br /> changes and added the verbiage to the request. The platform will be raised <br /> 18" also. <br /> Public comment: none. <br /> VOTE; Motion made and seconded to find negative with the language <br /> language added. Unanimous Vote, <br /> NEGATIVE DETERMINATION. <br /> 7:30 MILDRED BAKER, 42 Great Rawer Road, continued from 4 June <br /> 1998. Mr. Sherman advised the Board of Health is waiting for DEP <br /> consideration of the tight tank. There was no one to represent the applicant. <br /> Public comment: none. <br /> VOTE: Motion made and seconded to dismiss the application unless within <br /> 1p days the applicant consents to a continuance to 3 September 1998 <br /> at '7:30 p.m. Unanimous Vote. <br />
