23 July 1998 <br /> Page 7. <br /> Mr. Sherman recommended ordering the deck removed and to stay with <br /> Wayne Tavares' plan. Mr. Slavinsky advised the deck did not go over the <br /> work limit. Mr. Sherman stated the work limit was provided for access for <br /> machinery, not to construct the deck. Mr. Slavinsky agreed. The whole <br /> project moved back three feet. The deck is 10' x 40'. <br /> Public comment: Wane. <br /> VOTE: Motion made and seconded that the deck be removed within thirty <br /> days and that there be a daily fine in the maximum amount allowed <br /> by law until removed and that the contractor be fmed $100 for <br /> materially deviating from the approved plan. Unanimous Vote. <br /> Mx. Sherman stated there was a situation before where he noticed slash that <br /> was thrown over the bank and dumping of clipping in an area adjacent to the <br /> house on the north side which is killing vegetation there. This will be <br /> ordered removed in the enforcement order issued to remove the deck. <br /> VOTE: Motion made and seconded to allow the replacement of the failing <br /> retaining wall as shown on the plan. Unanimous Vote. <br /> HEARING CLOSED. <br /> 8:40 CRAIG LYNCH to amend the Order of Conditions for SE 43-1601 to <br /> permit after-the-fact installation of a generator and children's playhouse at <br /> 70 Popponesset Island Road. Arty. Carter, Mr. Sisson and Amy Ball were <br /> present for this hearing. After-the-fact fees were paid. <br /> Atty. Carter stated at a site visit, Mr. Sherman. noticed a play center and <br /> generator, not on the plans, and asked them to amend the order. The new <br /> plan moves the Picrate Ship back 35'. . <br />� Mr. Sherman stated concerning the pad for the generator, there is no <br /> performance standard that would prohibit it. He asked if it would be used <br /> only for a storm? <br /> Atty. Carter advised Mr. Bison's mother in-law is on a respirator which is <br /> tied into that and into the septic system and smoke detectors. The generator <br /> is only on one hour per week for testing. Mr. Sherman asked if there would <br /> be a problem with conditioning the timing. Atty. Carter stated it is on for one <br /> hour Wednesday at 1:00 p.m. <br />
