23 July 1998 <br /> Page S. <br /> A gentleman came forward and sated he represented the abutter and that <br /> this representation should include the fact that there is pool equipment <br /> cement pad. The Chair stated he world be given the opportunity to speak at <br /> the conclusion of the applicant's presentation. <br /> Atty. Carter continued there would be no problem conditioning the one hour <br /> as the Commission would like. <br /> Mr. Sherman stated he did not have he pool file in front of him and asked if <br /> there are any other structures there presently that were not originally <br /> permitted in the pool filing? Atty. Carter stated no, what he is referring to is <br /> the pump. It goes on a pad and is on the same location as the deck approved. <br /> Mr. Sherman asked if it is within the footprint of the pool and apron? Is the <br /> plan presented tonight accurate? Ms Ball stated yes. The pool is smaller and <br /> the apron is smaller. <br /> Mx. Sherman stated he wanted to know if the plan presented tonight is <br /> totally accurate? Atty. Carter stated it was. Mr. Sherman stated if what is <br /> being said is correct there is no problem but he felt this should be verified. <br /> He asked if it would be possible for the engineer to add the pool outline and <br /> location of the equipment on one plan. Ms Ball agreed. <br /> Mr. Rosenberg stated the Commission is being asked to approve something <br /> on a plan that is incomplete. That is an as butt and does not show the pool, <br /> Atty. Carter asked the Commission to close pending receipt of the plan. <br /> Mr. Green asked if there was any protection for fuel. storage in the area for <br /> the generator? W. Lynch stated no, it is natural gas. <br /> Mr. Sherman stated, for clarity, the revegetation done between the house and <br />� top of bank is inadequate and needs refinement. Secondly, he asked that <br /> this be the last of the glitches because it is problematical to have to go out for <br /> all these things. If there is to be a change, talk to the Commission first. <br /> Public comment: Stephen Snow, an attorney representing the <br /> Wachtenheims, abutters. He asked the Commission to note the difference in <br /> distance between placement of this generator between the Lynch dwelling <br /> and his client's dwelling. They are seeking an amended Order of Conditions <br /> to allow them to lease this generator. He showed some photographs to give a <br /> sense of what the unit looks like. <br />
