23 July 1998 <br /> Page 9. <br /> Mr. Sherman stated it should be made dear that this be relayed to <br /> performance standards of the Bylaw and the Act. <br /> Atty. Snow stated had-they followed conditions, he would not be here tonight <br /> because this would all have been talked about at a previous meeting. This is <br /> a particularly noisy generator. He left the premises tonight at 7:30 and it <br /> was running and he could hear it in the front door across the street. <br /> Mr. Sherman questioned why it would be running tonight. It was suggested <br /> it might be due to a power failure. <br /> Atty. Snow stated they oppose the placement of the generator. There is <br /> ample room for the generator to be moved away the bedroom of the <br /> Wachtenheuns, up towards the street. <br /> Mr, Rosenberg asked why the generator is as far from the house as possible? <br /> 1VIx. Sherman stated the location is not a problem from a performance <br /> standard standpoint and the Commission could not mandate they-move it, it <br /> would be acceptable to the Commission if they could be prevailed upon to <br /> move it. <br /> Atty. Snow stated if he were going to maks a wetlands argument, he would <br /> say that looking at this scale, this thing is loud. Pointing to the plan, he <br /> stated this is the vegetation area of the Wachtenh+eiim's property. If this <br /> thing runs as loud as tonight, it could scare off wildlife creatures and <br /> potentially have a damaging effect on this vegetative area they maintain. <br /> Again, had they come in here in the beginning and said that is where they <br /> were going to put this, his clients would have had an opportunity to voice <br /> their concerns and the Commi.ssian would have asked what difference there <br />� would be to stick it here (pointing). They are asking the Commission to do <br /> that now. The argument that they are going to incur expense would be to <br /> their detriment because had they followed the procedures, they would not <br /> have to incur any expense. Additionally, he noted the generator is hanging <br /> off the cement pad, it is going to have to be moved anyway and while they are <br /> at it, he asked that they mous it another 10 feet. <br /> Ms Ball suggested one of the best ways to reduce the noise would be to <br /> vegetate around the back and sides with subs. <br />
