20 August 1998
Page 12.
Mr. Sherman stated there have been discussions with the Building Inspector
and Mr. Smith. A plan is' needed verifying distances to the River and
changes the Building Inspector is loo g for. No permit will be issued
tonight. This will be heard by Board of Appeals on the 23rd of August.
Public comment: Richard Brady, an abutter, as how the low is zoned? Mr,
Smith advised it is residential. Mr. Brady asked why it is only assessed at
$800? Mr. Sherman stated that did not have anything to do with the filing.
Jim Hanks stated it is a very low-lying area. It gets inundated by less than
100 year storm events. From what he has seen, there are no details on what
the garage will be used for.. There is not a lot of distance of trees before you
are in the marsh.
i
W. Sherman stated they will have to meet the minimum 50' setback
requirement from the wetland edge.
Judie Brady asked if there were any environmental impact studies done?
Mr. Sherman stated before any final decision is made, he will have his
Assistant who has this expertise look at it.
i
Julie Brady asked if the Commission did not check for endangered
vegetation? Mr. Sherman stated he does look for that. This is not in a
 mapped rare species area.
Albert Lawton asked what is the reason for building a garage? Mr. Smith
stated for storage of two boats and the basics. Mr. Lawton stated there would
be fuel stored there. He asked why he would want a garage of that size at
such a distance from where he lives? Mx. Smith stated he would and asked
what is the objection? Mr. Lawton stated if it is a garage there would be fuel-,
it would have an effect on the environment.
Mr. Rosenberg stated all of the issues brought up so far are related to the
decision that has to be made at Board of Appeals, not here. It would come up
very importantly as to whether the Board of Appeals would grant a variance
from zoning laws.
An abutter asked if this land is in the flood plain. It was stated it is and he
then related a story about how a storm affected the area.
