15 July 1999
Page 4.
the opinion that they will never make that bean on the south side of I6 work and that he is awaiting final
reports from HLA Associates on why that failed. In the interim, the berm has not been vegetated because
they are waiting to find out why it slurped. They put stone on it(without inf nni us). We are
disappointed in their lack of communication. Several options are: legal action; convene a meeting with
Kathy Filey from DEP and Nark Forest from Congressman elahunt's office. As to the rest,we should go
into executive session to discuss.
7:35 MASHP E LEISURE SERVICES for a Determination of Applicability on a proposal to locate a
small storage trailer at South Cape Beach to store lifeguard and gate attendant"s equipment,Assessors Map
130. we have done this before, but the permit has lapsed. The trailer is on the pavement and would be
towed immediately in the event of a hurricane.
VOTE: Motion tion rade and seconded to find negative. Unanimous vote.
NEGATIVE I ETERNU TION.
9 Indian Museum Update. Irrigation and watering has been done during this dry period and the plants
are growing. The only thing remaining to be done is the sluiceway funneling the water off the parkmig
lot to the stormwat r filter. The cement contractor finished the upper part and the lower area, but the
area in between was never completed. They have not billed us. It was a small job and no one wanted
to do it. The job they did was fine but the did not connect it in the middle. Greg Taylor has
generously offered to asphalt it. I arra willing to continue watering this, but I need help it takes two
hours to water). It takes two people. If it stays this dry, someone has to help during the week. Letter
of thanks to the Conservation District--Don Liptaek and Dan Barnett, the engineer for the Natural
Resources Conservation Service---who went above and beyond, was presented and reviewed.
7:40 PENINSULA COUNCIL of New Seabury for renovations to Fells Pond Beach West at 68 Fells
Pond Road,Assessors Map 122,Block 178. (Question as to whether John Fitzsimmons should excuse
himself from discussion for conflict of interest—Commissioners.do not believe this is necessary) his is
about a 13,000 sq. ft. lot with 170 ft.path going down from Fells Pond Road. Over a period of gears
erosion from road runoff and foot traffic on the path has taken its toll. We would life to put in railroad ties
or landscaping ties to control the erosion,do planting along the side and keep it as natural as possible. In
the end where it goes into the water we would like to put some stairs. We would not be widening the
beach. There is a concrete collar coming from the drain out of the road which has Borne loose from the
4
concrete pipe and is of no value. This should be removed by hand(all work will be done by hand). We
have a DEP number, all abutters have been notified. The plantings are listed and Diane Boretos has looked
over the type of benches that will be put in. This land is owned by New Seabury an open space lot)and
they have given their approval.
Public Comment: none.
VOTE: Motion made and seconded to close the hearing. Unanimous Vote.
HEARING CLOSED.
7:45 CHAR-LES AGENT for a Determination of Applicability on removal and replacement of sundeck
with new footings at 11 whippoorwill Circle,Assessors Map 125,block 168. Elliot Rosenberg stepped
down for this bearing. Mr. Sherman stated the property is one-half axile from the water.
Public Comment: none
