Ms Fantozzi stated they are dealing with the Riverfront area which maximizes the setback from the river'to 200'. The Project is in the outer riparian zone. The septic is beyond the Zoo' on the lot. Mr. Sherman spoke with her about reorienting of the house to save a couple' of the lame trees. They thought they had done that but he brought up others. She will need to discuss this with her client. Also, this is in a Natural Heritage area. Paper cork was submitted on October 12, the thirty day period runs for a couple o more days. It was suggested to continue this to the 18thfor the plan revision and for the clock to be finalized on Natural Heritage. Mr. Sherman stated the repositioning of the house is not only to save two large impressively specimen Beech trees but also under the bylaw, the regulation for the riverfront which is Fart D of Regulation 33, he read a portion of this. "Notwithstanding any provisions of 310 CMR 10.58 4 1 and (1a), which is the Wetlands Act for the State Regulations, the 5000 square feet or 10% of theiverfront area within the lot, whichever is greaten of allowable alteration shall go as far from the river as is feasible without seeking zoning variances. They are not being asked to seek zoning variances. People are asked to push it as far away as possible} He is not sure that has been dome yet at this point in time. He asked Ms Fantozzi if there is a calculation of-whether or not they are within the 5000 square foot limit`s She stated yes, they provided a calculation of 4700 square feet.
