2 December 1999 <br /> Page 10. <br /> 8:00 NEW s ABURY PROPERTIES LLC., 3 Ocean Bluff Drive, continued <br /> from 29 July 1999. <br /> VOTE: Motion made and seconded to accept the request of the applicant <br /> that the Notice of Intent be withdrawn. Unanimous vote. <br /> WITHDRAWN <br /> 8:05 HOWARD G ASE , 403 Great oak Road, continued from 18 <br /> November 1399. Mr. Glaser was present with John Sl insky. <br /> Mr. Sherman stated the purpose of the continuance was to readvertise and <br /> renotify. The two lots have been combined. It was before the Commission <br /> previously with one douse on each lot. There is a denitrifying system and <br /> they have met the o' buffer. The project as drawn meets the performance <br /> standards. It is coastal bank which should be reflected. <br /> Mr. slavinsky pointed out the top of coastal bank is the flood zone line. They <br /> are off it. Mr. Sherman agreed. <br /> Public comment: none. <br /> VOTE: Motion made and seconded to close pending Board of Appeals action <br /> and revised plan with the flood zone lime shown. Unanimous Vote. <br /> CLOSED PENDING. <br /> 8:10 STEPHEN MILLER, 22 Squaw's Lane, continued from 23 September <br /> 1999. Norman Hayes presenting. At the last continuance, they were asked <br /> for construction documentation of the piers and breakaway panels_. <br /> meeting was held with the Building Inspector and the design meets state <br /> building codes. All other issues have been answered. <br /> Mr. Sherman stated he did discuss this .and the Building Inspector has <br /> accepted their plans but is waiting for a stamped copy. From a procedural <br /> standpoint, plans have to be in house five clays prior to the hearing which is <br /> not the ease. This will have to be continued though the design has been <br /> verbally approved as meeting the State building code. The question is the <br /> breakaway panel, in a storm event will they break away soon-enough? <br /> Mr. Mayos stated that was taken into consideration when designed. The <br /> design engineer was there with hire. <br />
