2 December 1999 <br /> 'age 12. . <br /> have fine tuning of the inland banks. The analysis and delineation has run <br /> its course and was done accurately. <br /> The Chair asked, before he called for public comments, that comments b <br /> confined to what is being done this evening. <br /> Ralph Baker stated it is a public meeting and it should address all concerns <br /> for the golf course. The Chair stated this hearing is only for the delineation. <br /> Mr. Baker stated on the Santuit River is an old flume used to flood the bogs <br /> by backing up S ntuit River. We have not had a draught but that would be <br /> used. on the other bogs, the way they were designed there will be a situation <br /> of water going upstream. <br /> Mr. Rosenberg stated this application has nothing to do with this. <br /> Bob Baker asked who controls those flumes at the present time? Mr. <br /> Rosenberg stated it is not within the Commission's jurisdiction according to <br /> State law. There is no application for any action to be taken on this land. <br /> Liar. Sherman stated water management activities have specifically <br /> exempted by state lav for active cranberry bogs, To clarify matters, it has <br /> been stated at previous hearings that if at any point they come back to <br /> perform actual work, there would 'have to be detailed information at that <br /> time. <br /> Harriet Hayward of Sandwich questioned the fact that cranberry bogs and <br /> wetlands are judged differently` She asked what happens if once those <br /> delineations are made the cranberry bogs are abandoned and become <br /> wetlands: Mr. Sherman stated they - are wetlands but enjoy special <br /> exempti-ons under the wetlands Protection Act.. If their function changes and <br /> they are no longer used for commercial cranberry production, they become <br /> wetlands which are fully rogul table and much more information about <br /> grater flow will have to be provided. <br /> Stuart Rapp asked if aR the acreage in this project is owned by otuit <br /> Development Company now? lair. Gray stated some is owned and some are <br /> under negotiation. Mr. Rapp expressed concern that a delineation would be <br /> issued on land not owned by the applicant. <br /> Mr. Gray stated law provides they may proceed with the delineation. The <br /> Commission is only ascertaining that the plan is accurate. <br />
