Phyllis P. Thompson, Cove Road, a continuance from <br /> October 7th-RDA. 'the Chairman called this matter to order and <br /> recognized John Fitch and John Schael . <br /> . Fitch informed the Commission that Applicant is <br /> requesting a Negative Determination in this matter. He noted the <br /> original filings were weak on the actual location of the resource <br /> area. He made reference to a pian which has been approved by the <br /> Planning Board, noting location of a temporary turn-around <br /> required by the Planning Board, drainage structures and grading. <br /> He also noted there has been some erosion due to road conditions, <br /> as said road remains open and 'incomplete. <br /> Mr. Fitch further stated the project is on "hold" due to a <br /> disagreement between utilities and the property owner. In <br /> response to concerns indicated by the Conservation Agent and the <br /> Assistant Agent, siltation fencing has been constructed and <br /> appears to be effective. Planning Board drainage calculations <br /> have been provided to the Assistant Agent, as requested. There <br /> had also been previous discussion as to whether or not it would <br /> be prudent to extend work- outside of the buffer zone. An <br /> engineer for the Applicant has addressed this issue. <br /> Ms. Boretos stated this ratter does fall within the <br /> jurisdiction of the Wetlands Act Town Bylaw. She stated that a <br /> Negative 3 approval in this matter could be determined provided <br /> assurance from Mr. Fitch that the siltation fence will be <br /> maintained until such time as the roadway is stabilized. she <br /> further suggested the drainage issues calculations with regard to <br /> the two lots be addressed through a Notice of Intent. <br /> Where was discussion regarding the current status of the <br /> silt fence/erosion conditions. <br /> Ms. Boretos reiterated her recommendation that this matter <br /> be approved under legative 3, with reference to Mr. Thulin' s Memo <br /> dated January 13, 2000 describing suggested erosion control <br /> measures. <br /> There being no public connent or further Commission <br /> discussion, the Chairman entertained a motion. <br /> MOTION: Ralph Shaw made a Motion for Negative <br /> Determination; which Motion was seconded by John Johansen and so <br /> voted unanimously. <br /> 8 : 40 Michael Valenti, 75 Edgewater Road, a continuance from <br /> January loth-lol .
