Fudala requested the Conservation Commission, as owners <br /> of the land, to prohibit and prevent this use of the land. He <br /> made a specific request that the Conservation Commission, in <br /> conjunction with the presentation of said Petition, address a <br /> letter to the Selectmen requesting they withdraw/delay Article <br /> #25 from the warrant in order to provide the Nater District, <br /> Conservation Commission, and. the neighbors an opportunity to <br /> study alternative actions. He requested this matter be addressed <br /> at the Selectmen' s Hearing scheduled for Noonday, March 20th* <br /> Mr. Fudala stated he has taken the liberty to examine a <br /> number of alternatives. He made reference to a large area of <br /> clearing made within the Stratford Ponds project on land that was <br /> suppose to be reserved as- Open Space under their Special. Permit. <br /> Unbeknownst to the Planning Board, the developer at the direction <br /> of the Nater District, cleared a forty o foot wade, two <br /> hundred fifty foot long path through the open Space area. <br /> Mr. Fudala was making reference to a plan, identifying Town <br /> Conservation Land, and that portion of land retained in the <br /> Permit approved by the Planning Board as a corridor between the <br /> two parcels of Open Space, which corridor has now been cut. <br /> Mr. Fudala suggested there exists a number of alternatives <br /> that do not involve disturbing conservation land or the <br /> disturbance of existing roads running through the conservation <br /> land. He also stated the costs of the proposed water main is to <br /> be paid by Stratford Ponds, and which will benefit the Stratford <br /> Ponds project. <br /> N±. Fudala requested a staff meeting in the near future with <br /> the Conservation Commission and Water District for the purpose of <br /> discussing some of the alternatives. <br /> George Green addressed the Chairman noting that once again, <br /> the Commission is in the position of having to determine a <br /> situation where someone is proposing work on conservation land <br /> without fist appearing before the Commission. <br /> Mr. Sherman informed ed the Conu'ni s ion he has information to <br /> share with regard to this matter. recognizing Mr. Fudala has <br /> presented legitimate concerns, he appeared to be uncertain as <br /> to whether or not it would be appropriate for the Commission to <br /> make a recommendation at this Meeting. He cited 'down -law <br /> Chapter 173, projects on Town-owned land, that residents have a <br /> right to petition and to appear before the Commission. <br /> Mr. Sherman stated he has no objection to a' staff meeting as <br /> suggested by Mr. Fudala. However he reiterated his uncertainty <br /> that the Commission could deny inquiry of the Water Department <br /> under the Regulations of Chapter 173 . The Commission may or may <br /> -3- <br />
