30 March 2000 <br /> Page 3. <br /> Ms Wilson advised there will be 1785 s.f. of new shrub layer to compensate <br /> for the 70' of new deck in the buffer zone; the remainder of the new deck is <br /> more than 50' away. They need a special permit from ZBA and are scheduled <br /> for 12 April. The lot is flat where the house is located and the driveway is <br /> impervious. They would put a drain up at the road. <br /> Mr. Green questioned the ACEC line? The entire lot is in the ACEC. <br /> Mr. Sherman stated there will be a net decrease in nitrogen. The Building <br /> Inspector has stated they will need a variance. In some cases the new deck is <br /> closer, if no more than 10', they are grandfathered. If Board of Appeals does <br /> apply, it could go no closer than 50'. This may be a case for compensatory <br /> vegetation. <br /> Ms Wilson felt Mashpee is unusual with the cooperation between Boards. <br /> There are issues for the Commission that are independent of ZBA. Clearly, <br /> the Building Inspector will make the determination for ZBA and how to <br /> measure the 10'. Rob Mills thought this design met requirements for a <br /> special permit and is not different than other projects that had gone to ZBA. <br /> It would be helpful if the Board could see their way clear to give guidance on <br /> environmental issues. 9% of the total lot area is to be vegetated. <br /> Mr. Green stated he would like to see the shrub buffer come up past where <br /> they have the hay bale line to establish habitat value. He raised the issue of <br /> the date on the plan. <br /> It was stated Mr. Levine would put in any shrubs the Commission requests. <br /> VOTE: Motion made and seconded to continue the hearing to 13 April 2000 <br /> at 8:05 p.m. at the request of the applicant. Unanimous Vote. <br /> HEARING CONTINUED. <br /> 7:35 NEW SEABURY PROPERTIES, Beach raking, continued from 2 <br /> March 2000. Michael Grotzke provided abutter notification receipts. <br /> Application is under the notice procedure since work is in the resource. They <br /> will rake at a certain time of the year, twice a week from Mean High Water to <br /> the toe of the coastal dune. Mr. Grotzke showed copies of the machine to be <br /> used to do the work. The Sandy Beach parking lot will be used. <br /> Ms Boretos advised efforts have made this a better project. <br /> b <br />
