He advised from the leach field to the retaining <br /> wall is 147'. <br /> Ms Boretos stated it is outside the flood plain. <br /> Public comment: none. <br /> VOTE: Motion made and seconded to find negative. Unanimous Vote. <br /> NEGATIVE DETERMINATION. <br /> 8:10 ROCK LANDING ASSOCIATION for a Determination of <br /> Applicability on a proposal to remove an existing stairway and install a new <br /> stairway at Pine Avenue. John Slavinsky presenting. The Association is 37 <br /> individuals who own 1/37th. It is the exact replacement of existing steps. Ms <br /> Boretos recommended negative. <br /> Public comment: none. <br /> VOTE: Motion made and seconded to find negative upon payment of taxes <br /> owed. Unanimous Vote. <br /> NEGATIVE PENDING. <br /> 8:15 JOHN MAHER, for a proposed vinyl sheet piling bulkhead to repair an <br /> existing wooden bulkhead at 39 Uncatena Road. Abutter notification receipts <br /> were provided. <br /> Ms Boretos advised she requested plantings that were added to the plan. She <br /> recommended approval with the mitigative plantings. She asked if they <br /> needed access for heavy machinery? A backhoe will be brought in. She <br /> stated if trees are to be cut, they will have to come back with mitigative <br /> plantings. <br /> Public comments: none. <br /> Mr. Sherman stated there will be conditions added to the Certificate of <br /> Compliance. <br />
