Mr. Sherman ,informed the Commission of Appl i cant e s <br /> withdrawal . <br /> The Chairman entertained a motion. <br /> MOTION: Greg Wirsen made a Motion to accept the withdrawal <br /> filed by the Applicant, Gary Vitale; which Motion was seconded by <br /> Carol Moore and so voted unanimously. <br /> Non-Hearing Agenda Items: <br /> Old Business: <br /> 1 . Request from David Jaye-Mr. Sherman reported a request <br /> for septic upgrade has been rade, with Applicant agreeing to the <br /> installation of a denitrifying septic system. <br /> The Chairman entertained a motion. <br /> MOTION: Greg Wirsen made a Motion to accept Applicant ' s <br /> request to construct a denitrifying septic system, pending <br /> submi s s i n of a revised plan for such, as well as Board of Health <br /> Approval; which Motion was seconded by Carol Moore and so voted <br /> unanimously. <br /> . Emergency Certificate, 39 Timberl ane-Mr. Sherman <br /> reported receipt of an engineered plan, Board of Health approval, <br /> and a scheduled meeting with the contractor regarding erosion <br /> control . This is to be Considered an emergency situation as the <br /> family has been without a septic system for three weeks. He <br /> requested signature of an Emergency Certificate this date. <br /> 7 : 05 Thomas Smith, 266 Monomo s C oy Road-Continued from <br /> 2/17/00 . <br /> The Assistant Agent reported a request for continuance has <br /> been made in this matter. <br /> Mr, Sherman further reported this natter is being heard <br /> before the Board of Health this date. <br /> The Chairman entertained a Motion. <br /> MOTION: Carol Moore made a Motion to continue this matter, <br /> at Applicant' s request, to May 11, 2000 at 8 : 10 p.m. ; which <br /> Motion was seconded by Ralph Shaw and so voted unanimously. <br /> . Ashum t Pond-Mr. Sherman informed the Commission of a <br /> meeting scheduled for May 4th from 6 : 00 to 8 : 00 p.m. t <br /> location yet to be determined; the subject of which is the <br /> proposed treatment of the phosphorous problem originating from <br /> the Base sewerage treatment plant impacting Ashuet Pond. <br /> 4 .
