He recommended approval. <br /> PUBLIC COMMENT: Atty. Dan Creeden was present on behalf of Don <br /> Blakeman. There is an on-going lawsuit re some encroachment on the <br /> driveway. There is objection to the work proposed. It loops life this plan is <br /> a blow up of the subdivision plan superimposing topo. Work will be very <br /> close to the property line. The Commission could be approving work to go <br /> over the property line. <br /> Mr. Sherman stated the permit does not convey property rights. It is the <br /> responsibility of the two parties to adjudicate this. The driveway. only has to <br /> meet the performance standards of the act. The abutter can appeal under the <br /> Act. <br /> Atty. Creeden stated the other problem is it does not show ghat is existing on <br /> the drive, or the extension. It should show what is on the ground now. The <br /> retaining gall adjacent to the pervious drive is not shown. The driveway has <br /> been extended on the next property. The hearing should be continued for an <br /> updated plan, 'There is no delineation of the inland bank. There should be <br /> an engineered, surveyed plan. <br /> Mr. Sherman stated they do not meed this for the lawn and retaining walls <br /> less than 5 feet. They should soy what was not on the original plan and <br /> agreed it should be continued. All the work is permittable but there are <br /> some things not shown <br /> VOTE: Motion made and seconded to continue to 6 July 2000 at 7:45 p.m. <br /> at the request of the applicant.
