voted unanimously. <br /> Non-Hearing Agenda <br /> Old Business <br /> 2 - EDB Test Results-Mr. Sherman reported EDB hits <br /> continue in the bogs, and will impact how this matter will move <br /> forward. He stated he would provide Copies for the Bog <br /> Subcommittee; and suggested the Commission vote to enter~ <br /> Executive Session in order to further discuss negotiations with <br /> the Air~ Force. <br /> . Efron-Change of Boat-Mr. Sherman reported the Order of <br /> Conditions requires the Conservation Department/Commission to be <br /> advised and to seek permission upon any change in the status of <br /> the boat; which requirement has not been met . According to -the <br /> plan, the water~ depth is approximately 26-inches; the new boat <br /> requires 42-inches of draft, as stated in a letter received from <br /> the Applicant. <br /> Elliot Rosen reported there are three boats on <br /> Applicant ' s dock the extended driveway is being used to launch <br /> boats and personal watercraft. <br /> Mr. Sherman suggested the Conmission issue an Enforcement <br /> Notice to the Applicant, requesting an on-site for determination <br /> of possible damage to the marsh grass, as well as ars approval o <br /> the Change in boat status. <br /> There being no public comment or further Commission <br /> discussion, the Chairman entertained a notion. <br /> MOTION: Elliot Rosen made a motion to issue an Enforcement <br /> Notice, requesting -an on-site inspection to determine possible <br /> damage to marsh grass, and approval of the change in boat status; <br /> which Motion was seconded by Ralph Shaw and so voted unanimously. <br /> 7:20 New Seabury Properties, LLC-Beach - Nourishment, <br /> continued from June 22, 2000, NCI . <br /> The Chairman recognized Norman Hayes, BSC, representing the <br /> Applicant, who provided a beach nourishment plan for Commission <br /> review. References were being made to said plan regarding the <br /> location of profiles. He also indicated the areas that Applicant <br /> is currently responsible for maintaining. <br /> Mr. Mayes reported that rational Her has advised in <br /> writingthat the area under discussion is not a shore bird <br /> habitat; however there remains to a some question this <br /> regard, and further Confirmation is expected. <br /> Regardless, Mr. Mayes stated the potential closing of this <br /> Hearing should not be impacted as Applicant agrees potential <br />
