27 July Zoo <br /> Page 3. <br /> Natural Heritage will be looking at be ethic samples, to look at ghat is there <br /> on the bottom. Mr. Smith stated they do not anticipate much in that area <br /> they are treating because there is no oxygen in the water in the summer <br /> season. The goal of the project in treating that area and getting phosphorus <br /> out of the water column is to improve the overall oxygenated conditions of the <br /> pond which will enhance habitat. <br /> The Chair asked when they anticipated having , a response for the <br /> Commission's files that they do not need the habitat survey? Mr. smith <br /> stated their read on the regulations is that the Habitat survey is not <br /> triggered but they are making steps with working with Natural Heritage to <br /> do some habitat survey work anyway. If the Commission requires an answer <br /> from that organization, or another, Mr. Smith was sure they would be willing <br /> to provide that as that data is collected in the next couple of weeks. <br /> The Chair asked what would happen if they don't agree with your? Inas that <br /> been investigated? Is there a response from there that their input is not <br /> needed? Mr. smith looked at the regulations and looked at the triggers or <br /> criteria which drive the Habitat Survey and does not see that it is needed but <br /> they are making steps to conduct some work to address concerns that have <br /> come up about habitat, He thought an answer could come very shortly from <br /> the Natural Heritage & Endangered if requested, that they are supportive of <br /> the program. <br /> The Chair asked if they had approached there? Mr. Smith advised they have <br /> had a number of discussions with there to find out about the species of special <br /> concern and discussing the project. <br /> Mr. Smith advised another issue that has come up, the Division of Fisheries <br /> and wildlife has indicated that a permit will be needed to use the Boat ramp. <br /> p. <br /> The question has risen, does that trigger 1 I ? The read they get from the <br /> Director of MEPA is no. <br /> Returning to the rare species, or benthic survey, what is identified in <br /> s umet Pond (and they do have a letter from Natural Heritage <br /> Endangered species program identifying the species of concern), they are not <br /> threatened or endangered, they are species of special concern. It is the <br /> tidewater mucket, a mussel that lues on the bottom of the pond and two <br /> plants that lure in the margins. The plants are not an issue. They do not <br /> expect the mussel to reside that deep area they are going to treat as it is not <br />
