The hearing can a closed upon meeting with Steve Furley to <br /> reconfirm he is m agreement. <br /> l/Ir. Rosenberg had no comments. He commended Mr. Sherman for doing a <br /> great job. <br /> Mr. Fitzsimmons asked for a copy of the Executive Summary for all the <br /> members. Mr. Minior agreed. <br /> Ms Boretos asked the Commission to place a condition in the Amended Order <br /> that references an agreement that is being worked out with EPA to look at a <br /> trigger threshold for fish sampling. 1r. Sherman stated if EPA is asking for <br /> it the Commission can cross-reference it. <br /> Mr. Mi r Mated there is already a requirement in that decision to sample <br /> fish this year and next year to loop and see if there is any EDB in the tissue <br /> of the fish. Where was some input provided by Ken Finklestein of NASI <br /> who is the Trustee for the Natural Resource Marine Fisheries. It appears <br /> that in his original assessment of the situation he had the concentration <br /> levels incorrectly. He thought they were in the ppm range, they are in the <br /> ppb range with the EIB and EPA is working with them right now to clarify <br /> the initial. assessment. It may not even be a requirement to sample the fish. <br /> Once worked out with EPA, the record decision will stand that will require' <br /> then to sample the fish or the record decision will be modified to e. urinate <br /> the requirement. He suggested the condition imposed talks to the <br /> requirements of the record decision for the Fuel Spill 1 Plume ground Vater <br /> Contamination be implemented in accordance with the approval of IPPA and <br /> DEP. <br /> Ms Boretos stated for the record, the Commission has the authority under the <br /> eight interests of the Wetlands Protection Act and the Bylaw to put in that <br /> condition in and of its own. accord. w <br /> Mr. Virsen did not know what good the information would do without the <br /> risk assessment. <br />
