October 2000 <br /> Page 5. <br /> Mr.Talbot stated anyone else conning before the Commission is only allowed to vista prune 50f in <br /> total. They already have a very large vista pruned area by virtue of the violations. <br /> Mr. Sherman stated wildlife has been compromised by this illegal activity only partially rectified. <br /> He proposed that Mr. Casey provide a plan for restoration of this more completely with some <br /> shads which will grow high, maybe a tupelo or two and since he could request an extension in <br /> three years, h could be given one of the corridors for now, let this grow back under a plan and <br /> re-evaluate it in -1 years and come back with an amended order and an extension. <br /> Mr.Rosenberg stated that would be satisfactory. <br /> Mr.Casey stated he would not mind putting in more than the ten blueberries and inkb cries. <br /> Mr.Sherman stated the second corridor would have to be cut down to an appropriate size. <br /> It was agreed to give the applicant one corridor for now, have him come back and re-evaluate it <br /> in two years. <br /> 11r. Casey asked if the Commission wanted a plan for the plantings? DEVELOPMENT CO., INC. to amend the Order of Conditions for SE -1677 to <br /> permit construction of a deck and two small retaining walls at 23 Bayshore Drive. Norman <br /> Mayes represented the applicant. Abutter notification receipts were provided.. It is ' from the <br /> wetland. They have come up with a revegetation plan for the area they encroached upon <br /> beyond the 0' with Tupelos,white oak,etc. <br /> Mr. Sherman advised the applicant was told the plants could go in anytime and they should go in <br /> soon. This is under an enforcement situation. It could be conditioned nothing be issued until <br /> the planting is done in accordance with the enforcement order. He asked Mr.'Hayes if anyone is <br /> in charge of the site now? Mr. Hayes was not aware of anyone. In that case, Mr. Sherman <br /> recommended denial of the project unless Mr. Hayes will provide a letter in five business clays <br /> that his firm is in charge of the restorative plantings. <br /> Public comment: none. <br /> VOTE: Motion made and seconded to allow the amendment to issue only upon completion <br /> of all the terns of the enforcement order anti under the supervision of a Mass. <br /> Certified Arborist. Unanimous Vote. <br />
