Joyce stated he had n <br /> problem, he thought everyone was on the sane page. <br /> Mr. Sherman stated if the hearing is closed pending that, there will not be ars <br /> opportunity for further dialogue. <br /> Atty. Joyce stated - he would like to make' a point as many of the Board <br /> members were not Dere on the 16th of 'October and he wanted to be sure <br /> everyone had a clear grasp of what happened on the 1 . He asked if anyone <br /> had any questions on that? <br /> Mr. Sherman stated no, details of the return were requested and that has been <br /> provided. It looks sound. <br /> Mr. Rosenberg asked what if there is no agreement Mr. Sherman stated it is <br /> n unusual situation. The Commission understands the sensitivity of the <br /> situation and put forth that offer. The message he got from 'Ion Counsel <br /> today was they received it; they didn't have any particular problems with it arra i <br /> just wanted a chance to discuss it. He cannot control ghat comes out of triose <br /> discussions. <br /> Atty. Joyce stated they are not waiving any rights with respect to the access <br /> issue but if there is some problem, he assured the Commission he could work <br /> it out with Town Counsel. <br /> Mr. Rosenberg rg stated the hearing. should be continued under the <br /> circumstances. Mr. Sherman stated he was just putting forth the possibilities. <br /> Mn Rosenberg stated-if there is no agreement, the Commission would be faced <br /> with an impossible situation if this were closed. <br /> Clark Hill stated his sense is that we have something, being reasonable people, <br /> that is agreeable to reasonable people and he would see that going forth, at this <br /> point, is not a problem on his partbecause of the feeling that he gets back that <br /> there is reasonable dialogue and we are so much there it is a moot point. <br /> Mr. Talbot asked if the concern is that they may come back with something <br /> different and then there would be the potential that something else would go <br /> Mr. Sherman stated even if there were not agreement they could ask the <br /> Commission to reconsider or have further negotiations with Town Counsel, or <br /> worst ease scenario.,they have the right of appeal. <br />
