There is a conflict here <br /> with boating access vs. the interests of the Act. Under coastal Durres, <br /> which says that when a Coastal Dune, whichi n the Barrier Beach, i <br /> to be determined to besignificant to Storm Damage Prevention, Flood <br /> Control or Protection ofWildlife Habitat, any alteration Or a structure o <br /> a Coastal-Dune, or within loo feet of a Coastal Dune, shall not have ars <br /> adverse effect on the coastal Dune by affecting the ability of the waves to <br /> remove sand from the dune, interfering with the landward or lateral <br /> movrement ofthe dune causing removal f sand from the 1u artificially, <br /> disturbing the vegetative cover so as to destabilize the dune. <br /> Under 310 CMR 10.27 3 under Coastal Beaches, including tidal flats, <br /> when a coastal beach is determined to be significant to Storm Damage <br /> Prevention and Flood control, or Protection of Wildlife Habitat, any <br /> project on coastal Beach, except for any project permitted under 10.30 <br /> (3a) shall not have an adverse effect by increasing erosion, decreasing the <br /> volume or changing the form of any such coastal beach on adjacent <br /> downdrift coastal beach. <br /> Under Lecky Intertidal, 10.31 (3), it spears to when rocky intertidal i <br /> determined to be significant to Storm Damage Prevention, Flood control, <br /> or Protection of Wildlife Habitat, any project proposed shall be designed <br /> and constructed using the best -practical measures so as to minimize <br /> adverse effects on the form or volume of exposed intertidal bedrock and <br /> boulders. <br /> Ms Boretos stated all of the Barrier Beach Performance Standards apply <br /> to this project. <br /> Under Salt Marsh, Ms Boretos thought there is a potential with the <br /> Channel of precluding the additional salt marsh from growing out <br /> towards the channel or out in the northerly area because of the water <br /> velocity. <br /> Under the Town Wetlands Bylaw, Chapter 172, Regulation 17, which <br /> speaks to coastal Resource Areas, it just references the Wetlands <br /> Protection Act regulations. It also mentions in addition, except as <br /> specifically provided by these regulations, the Commission shall not <br /> permit any work on coastal Resource rce areas or within 100 feet of a <br /> resource area that will. impair the resource areas functional <br /> characteristics. <br />
