Mr.. Sherman determined the IOA float is existing, request is being made for construction of a ramp starting on dry land towards the- float . Applicant explained he had been unaware that he was in - violation, he has dismantled the ramp and filed an application with the Conservation Commission. This is to be considered ars interim solution until such time as the Harbor Master can be consulted. Mr. Sherman recommended Negative Determination as the area consists f a sandy beach, with no B w impacts or shellfish issues . There being no further Commission or public comment, the Chair ian entertained a emotion. MOTION: Elliot Rosenberg made a Motion for Negative Determination, which Motion was seconded by Ralph Shaw and s voted unanimously. 7 .- OS Dominic Tiberio, 1S. Ockway Bair Road, continued from March 29, 2001 . NOT Mr. Sherman explained this matter to be a salt water~ dock facility. upon inspection it was determined that one portion of the wetland area qualifies as a BVW. The area of fresh water vegetation has been identified and shows on a revised plan. The Chairman recognized Jack Landers-Cauley, Civil Engineer in private practice, representing the Applicant. References were being -made to a Site Plan prepared for Dominic Tiberio, revised 05/25/01, by J. E. Landers-Cauley, P. E. All resources are indicated on' said plan, both fresh and salt water. . Sherman determined that due to the shallow conditions, the area would have to be conditioned t'a z otorle s craft" . Mr. Lander -Cauiey stated Applicant has every intention of identifying this project as a dinghy dock. The Chairman recognized Rick York, Shellfish warden, who stated the proposed project would cause no problems for shellfish. Mr. Sherman recommended approval, conditioned it be identified as a dinghy dock, contingent upon receipt of the Shellfish warden' s memo and Hoard of Appeals approval . There being no further Commission or public ' comment, the Chairman entertained a motion. -3-
