Mr.. Sherman determined the IOA float is existing, request is <br /> being made for construction of a ramp starting on dry land <br /> towards the- float . <br /> Applicant explained he had been unaware that he was in - <br /> violation, he has dismantled the ramp and filed an application <br /> with the Conservation Commission. <br /> This is to be considered ars interim solution until such time <br /> as the Harbor Master can be consulted. <br /> Mr. Sherman recommended Negative Determination as the area <br /> consists f a sandy beach, with no B w impacts or shellfish <br /> issues . <br /> There being no further Commission or public comment, the <br /> Chair ian entertained a emotion. <br /> MOTION: Elliot Rosenberg made a Motion for Negative <br /> Determination, which Motion was seconded by Ralph Shaw and s <br /> voted unanimously. <br /> 7 .- OS Dominic Tiberio, 1S. Ockway Bair Road, continued from <br /> March 29, 2001 . NOT <br /> Mr. Sherman explained this matter to be a salt water~ dock <br /> facility. upon inspection it was determined that one portion of <br /> the wetland area qualifies as a BVW. The area of fresh water <br /> vegetation has been identified and shows on a revised plan. <br /> The Chairman recognized Jack Landers-Cauley, Civil Engineer <br /> in private practice, representing the Applicant. <br /> References were being -made to a Site Plan prepared for <br /> Dominic Tiberio, revised 05/25/01, by J. E. Landers-Cauley, P. E. <br /> All resources are indicated on' said plan, both fresh and salt <br /> water. <br /> . Sherman determined that due to the shallow conditions, <br /> the area would have to be conditioned t'a z otorle s craft" . Mr. <br /> Lander -Cauiey stated Applicant has every intention of <br /> identifying this project as a dinghy dock. <br /> The Chairman recognized Rick York, Shellfish warden, who <br /> stated the proposed project would cause no problems for <br /> shellfish. <br /> Mr. Sherman recommended approval, conditioned it be <br /> identified as a dinghy dock, contingent upon receipt of the <br /> Shellfish warden' s memo and Hoard of Appeals approval . <br /> There being no further Commission or public ' comment, the <br /> Chairman entertained a motion. <br /> -3- <br />
