There being no further Commission or public comment, the <br /> Chairman entertained a motion. <br /> MOTION: Elliot Rosenberg made a Motion to accept the <br /> letter as submitted, extending the period for Jurisdictional <br /> Determination by the Cape Cod Commission, to February 28, 2002; <br /> which Motion was seconded by Ralph Shaw and so voted unanimously. <br /> There being no further public comment/questions made to the <br /> Commission, the Chairman called the first Hearing. <br /> 7: 00 Faith Garcia, a continuance from May 24, 2001. NOI <br /> Mr. Sherman reported Applicant has requested a continuance <br /> to allow for refinment of the plan and additional mitigation. <br /> MOTION: Elliot Rosenberg made a Motion to continue the <br /> matter to May 24, 2001, 7 :45 p.m. , at Applicant ' s request; which <br /> Motion was seconded by Ralph Shaw and so voted unanimously. <br /> 7 : 05 Dominic Tiberio, 15 Ockway Bay Road, continued from <br /> March 29, 2001 . NOI <br /> Mr. Sherman reported the matter had been continued to <br /> provide the Consultant, Jack Landers-Cawley, an opportunity to <br /> redefine the wetland line. However, Mr. Landers-Cawley has not <br /> made a contact to arrange, for an on-site. Mr. Sherman suggested <br /> the matter be further continued. <br /> The Commission agreed to continue for one month. <br /> MOTION: Elliot Rosenberg made a Motion to Deny unless <br /> (within 10-days) Applicant applies for a continuance to June 7, <br /> 2001, 7 : 05 p.m. ; which Motion was seconded by Michael Talbot and <br /> so voted unanimously. <br /> Non-Hearing Agenda <br /> old Business' <br /> 1 . Certificate of Compliance for SE 43-1906 - Diane Boretos <br /> explained this is a new house, 190 Redding Place Road. Revised <br /> plans which include a patio have been submitted; and revegetation <br /> to compensate for some intrusion into the naturally vegetated <br /> buffer strip has been completed. She recommended approval and <br /> Commission signature. <br /> 2 . Mr. Sherman reported New Seabury has requested <br /> permission to use a vehicle on the beach for a period of two (2) <br /> hours in order to set-up lifeguard stations . This annual <br /> request has always been granted. <br /> MOTION: Elliot Rosenberg made a Motion to permit the <br /> request by New Seabury to use a vehicle on the beach for the <br /> purpose of setting the lifeguard stations; which Motion was <br /> -2- <br />
