Plan, April 24, 2001, Cape & Islands Engineering File #125" . He <br /> made reference to existing site conditions, stating the septic <br /> system has failed. The proposed demolition of the house would <br /> allow for construction of a new house to be elevated, elimination <br /> of the pump chamber, and relocation of the septic tank. <br /> Mr. Sanicki proposed a 35 foot work limit setback, drywells, <br /> and augmentation of plantings along the existing BVW (red cedar, <br /> inkberry, bayberry) . Construction of the new house will be done <br /> in accordance with flood requirements. <br /> Diane Boretos suggested the mitigation plantings be <br /> considered a line of the naturally vegetated buffer, in order to <br /> create a buffer in the future as none currently exists . <br /> The Conservation Agent agreed that the Regulations state a <br /> naturally vegetated buffer area be established, whenever <br /> possible, if one does not exist . <br /> Ms. Boretos noted that some of the BVw has been cut (in the <br /> open area) and that some restoration is in order. <br /> There was some general discussion regarding the placement of <br /> shrub plantings . <br /> Ms . Boretos recommended approval pending submission of a <br /> revised plan showing a four (4) foot wide path, mitigation <br /> vegetation, identification of the naturally vegetated buffer <br /> strip which is not to be mowed. <br /> The Clerk requested an Attestation of Ownership. <br /> The Chairman recognized the Applicant who came forward for <br /> clarification of the Decision made by the Commission (which was <br /> explained by the Assistant Conservation Agent) . <br /> Applicant expressed concern for possible contraction of lyme <br /> disease as a result of allowing the growth requested by the <br /> Commission. <br /> In response, Mr. Sherman made reference to Chapter 172, <br /> Section 7, which provides for these concerns. <br /> There being no further Commission or public comment, the <br /> Chairman entertained a motion. <br /> MOTION, Elliot Rosenberg made a Motion to Close pending <br /> receipt of a revised plan showing a four (4) foot wide path, <br /> mitigation vegetation, and identification of the naturally <br /> vegetated buffer strip which is not to be mowed, as well as <br /> receipt of an Attestation of Ownership; which Motion was seconded <br /> by Ralph Shaw and so voted unanimously. <br /> -5- <br />
