7: 30 Robert Diverdi for Determination of Applicability on <br /> construction of a dwelling at 11 Nehoiden Road, Assessors Map <br /> 125, Block 110 . <br /> Mr. Sherman explained the matter to be a Flood zone issues. <br /> The concern is to maintain a certain area of natural vegetation <br /> and to limit the house to two-bedrooms unless a denitrification <br /> unit is installed. Delineation of a natural vegetation area is <br /> to be determined. <br /> It was determined that foundation clearing had been done <br /> without benefit of a permit. <br /> At this point Elliot Rosenberg stepped down from the <br /> xearing. <br /> Mr. Sherman made reference to the architectural plans <br /> indicating an "office" and "study" and for which a door for <br /> privacy is being proposed. He stated these areas could be <br /> considered to be bedrooms and suggested the only way to insure <br /> use as a study and office would be to construct an opening <br /> larger than the standard door opening and to eliminate the <br /> closet space. <br /> Mr. Sherman recommended approval as a Negative Determination <br /> pending a meeting between himself and Applicant in order to <br /> verify the lot is in conformance (bedrooms and area of natural <br /> vegetation) . <br /> There being no further Commission or public comment, the <br /> Chairman entertained a motion. <br /> MOTION: Michael Talbot made a Motion for Negative <br /> Determination pending Conservation Agents review to confirm <br /> the required twenty (20W) percent of the lot remains in a <br /> naturally vegetated state, and that only two (2) bedrooms are <br /> shown on the revised architectural plans . If these outstanding <br /> issues are not confirmed, a Positive Determination will be <br /> made. Said Motion having been duly made and seconded it was <br /> so voted unanimously. <br /> 7 : 35 Ralph Cistoldi to amend the Order of Conditions for <br /> SE 43-2018 to permit the substitution of wood planking from the <br /> walkway decking proposed at 89 Tide Run, Assessors Map 120, Block <br /> 188 . <br /> The Assistant Conservation Agent explained the plan <br /> indicated the use of an artificial substance on the planking; the <br /> Order of Conditions made a reference to wood being used. <br /> Applicant is requesting permission for the use of wood as it <br /> would prove to be an enormous financial burden (considering the <br /> length of dock) if the other materials were used. <br /> -6- <br />
