Diane Boretos requested Applicant address the issue of <br /> submission of a Revegetation Plan focusing on additional cutting <br /> which has been done on the property. <br /> Applicant had been under the impression the plan had been <br /> submitted; Ms . Boretos clarified said Revegetation Plan has not <br /> been submitted. It was determined that Applicant' s <br /> representatives (attorney and landscaper) have not contacted the <br /> Conservation Agent for resolution of this matter as was <br /> previously agreed. <br /> Applicant expressed his desire to comply with Conservation <br /> Commission regulations. <br /> Ms. Boretos suggested Applicant bear responsibility to gain <br /> information required by the Commission and to appear again in <br /> late August, at which time it might be possible to resolve this <br /> matter~ to the Commission' s satisfaction.. <br /> Ms. oretos instructed Applicant quite clearly to submit <br /> levegetation Plan to the Conservation Commission at least one 1 <br /> week prior to August 23, 2001. <br /> The Chairman clarified to Applicant that the Owner} of the <br /> property is ultimately responsible before the Con is-sion. <br /> Ms. Boretos explained that the Conservation Agent has <br /> requested additional information for submission regarding <br /> restoration plantings . <br /> There was some discussion regarding a Court order for <br /> completion of the Notice of Intent. <br /> Elliot Rosenberg explained Town Counsel has provided a <br /> letter outlining the Court order. A detailed Landscaping Plan <br /> must be submitted to the Conservation Comision for approval, <br /> which has not been done. <br /> Applicant acknowledged his understanding of said Count Order <br /> and assumed responsibility to provide a Landscape Plan for <br /> approval by the Conservation Commission. <br /> There being no Commission or public comment, the Chairman <br /> entertained a motion. <br /> LOTION: Carole Moore rade a Motion to continue the Nearing <br /> .in this matter to August 23, 2001 at 7: 08 p.m. , at Applicant ' s <br /> request; which Motion was seconded by Ralph Shaw arra so voted <br /> unanimously. <br /> 8 : 15 Peter K. Doran to amend the Order of Conditions for <br /> SE 43-1897 to permit an expanded riprap repair and allow <br /> unapproved landscaping to remain with installation of additional <br /> -13- <br />
